தினம் ஒரு சட்டம் - விபச்சார குற்றங்களும் அதன் தண்டனைகளும்

இ.த.ச 497- பிறர் மனைவியுடன் விபச்சாரம் செய்வது

     யாராவது , பிறருடைய மனைவியுடன் அல்லது பிறருடை மனைவி என நம்புவதற்கு வாய்ப்பு இருந்தும், அவளுடைய கணவனுடைய அனுமதி அல்லது ஒத்துழைப்பு இன்றி, அவளுடன் உடலுறவு செய்வது பிறன் மனைவி புணர்தல் என்ற குற்றமாகும்.

     இந்தக் குற்றத்திற்கு ஐந்து ஆண்டுகள் வரையில் சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும்.

வன்முறைப் புணர்ச்சி என்ற கற்பழித்தல் இந்தப் பிரிவின் கீழ் வராது.

     மேலும் குற்றத்திற்கு உடந்தையாக இருந்தார் என்று கருதி அந்தப் பெண்னை தண்டனைக்குள்ளாக்க இயலாது.

Section 497- Adultery

     Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rap, is guilty of the offence of adultery, and


shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case the wife shall be punishable as an abettor.

STATE AMENDMENT

State of Andhara Pradesh Amendment

Punishment-Imprisonment for 5 years, or fine, or both-Cognizable-Bailable-Triable by Magistrate of the first class-Non-compoundable.

இ.த.ச 498-பிறருடைய மனைவியை கவர்த்தலும் மறைத்து வைத்தலும்

            யாராவது, பிறருடைய மனைவி அல்லது பிறருடைய மனைவி என்று அறிந்த ஒரு பெண்ணை அல்லது பிறருடைய மனைவி என்று உணர்வுவதற்கேற்ற வாய்ப்பிருந்தும் , 
         
            அந்தப் பெண்னை அவளுடைய கணவனிடமிருந்து அல்லது கணவன் சார்பில் பாதுக்காக்கும் ஒரு பொருப்புடையவரிடமிருந்து, 

     வேறு ஒருவருடன் முறைக்கேடான புணர்ச்சி செய்யும் பொருட்டு அழைத்து செல்வதும் அல்லது இச்சைக் காட்டி இழுத்து செல்வதும் குற்றமாகும்.

     அந்தப் பெண்னை அத்தகைய காரணத்துடன் மறைத்து வைப்பதும் , தடுத்து வைப்பதும் குற்றமாகும்.

      இந்தக் குற்றத்துக்கு இரண்டு ஆண்டுகள் வரை சிறைக் காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும்.

Section 498- Enticing or taking away or
detaining with criminal intent a married woman

        Whoever takes or entices away any woman who is and whom he knows or has reason to believe to be the wife of any other man, form that man, or from any person having the care of her on behalf of that man, with intent that she may have illicit intercourse with any person, or conceals or detains with that intent any such woman,

        shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
