தினம் ஓரு உரிமை - Prohibitio - தடைவிதிக்கும் நீதிப் பேராணை


    Prohibitio (Prohibit) என்பது இலத்தின் வார்த்தையாகும் இதன் பொருள் தடைவிதித்தல் அல்லது நிறுத்திவைத்தல் என்பதாகும்.  ஆங்கிலத்தில் இதனை Prohibit அதனை Prohibition என்றும் கூறுவார்கள்.



             இந்த ஆணையின் கீழ் நீதிமன்றங்கள் தனக்கு கீழ் உள்ள நீதி மன்றத்துக்கோ அல்லது குவாசி நீதிமன்றத்துக்கோ அல்லது தீர்பாயத்துக்கோ ஒரு 
ஆணையிட்டு நடைபெற இருக்கும் ஒரு சட்டரீதியான விசாரணையை அல்லது சட்ட ரீதியான தீர்ப்பை நிறுத்தவோ அல்லது நடைபெற்றுக் கொண்டிருக்கும் ஒரு காரியம் அல்லது செயலை நிறுத்த முடியும்.  



    எப்போதெனில் 

1 . ஒரு குடிமகன் ஷரத் 12 முதல் ஷரத் 35 வரையுள்ள அடிப்படையுரிமை பறிக்கும் போது இந்த நீதிப்பேரணை வேண்டி முறையிடலாம். 

2. தனக்கு கீழ் உள்ள நீதிமன்றம் தனக்குள்ள வரம்பை மீறும்போது

3. தனக்கு கீழ் உள்ள நீதிமன்றம் - நீதி அல்லது தீர்ப்பை சரியாக சரியாக நடைமுறைப்படுத்தாதப் போது

4. ஒரு தவறான பதிவு உள்ள அறிக்கை அல்லது சான்றை மையமாக வைத்து தீர்ப்பளிக்கும் போதும்.







Writ of Prohibition:
 
    A writ of prohibition is issued primarily to prevent an inferior court from exceeding its jurisdiction, or acting contrary to the rule of natural justice, for example, to restrain a Judge from hearing a case in which he is personally interested.

     The term “inferior courts” comprehends special tribunals, commissions, magistrates and officers who exercise judicial powers, affecting the property or rights of the citizen and act in a summary way or in a new course different from the common law. It is well established that the writ lies only against a body exercising public functions of a judicial or quasi- judicial character and cannot in the nature of things be utilised to restrain legislative powers.
 


        These Writs are issued as “alternative” or “peremptory.” An alternative Writ directs the recipient to immediately act, or desist, and “Show Cause” why the directive should not be made permanent. A peremptory Writ directs the recipient to immediately act, or desist, and “return” the Writ, with certification of its compliance, within a certain time.

       The writ can be issued only when the proceedings are pending in a court if the proceeding has matured into decision, writ will not lie.



When Can be a Writ of Prohibition be granded !?

1. Where the inferior court exceeds its jurisdiction.
2. Where the inferior court acts without its jurisdiction.
3. Where the principles of  Natural Justice are violated.
4. Where the fundamental rights of a person are violated.
5. Where the error apparent on the face of the record is considered.
