தினம் ஓரு உரிமை - mandamus - அரசுக்கு உயர் நீதி மன்றம் இடும் ஆணைகள்


mandamus என்பது இலத்தின் வார்த்தையாகும் இதன் பொருள் நாங்கள் ஆணையிடுகிறோம் அல்லது We Command என்பதாகும்.

 

                 இந்திய குடிமக்களின் உரிமைகளை நிலைநாட்டுவதற்கு நம் அரசியலமைப்பு சட்டம் பல  அம்சங்களை வழங்கியுள்ளது. அதில் மிக முக்கியமானது நீதி பேராணைகள். ரிட் மனு என சொல்லப்படும் இந்த நீதிப்பேராணை கள் ஐந்து இருக்கிறது. இதில் இரண்டாவதாக அதிகம் பயன்படுத்தப்படுவது mandamus எனப்படும் நீதிப் பேராணையாகும். 

       இந்த ஆணையின் கீழ் நீதிமன்றங்கள் ஒரு ஆணையின் வாயிலாக தமக்கு கீழ் உள்ள ஒரு மன்றத்தையோ அல்லது அரசு அலுவலத்தையோ அல்லது ஆனையத்தையோ ஒரு செயலை நிறுத்தவோ அல்லது தொடரவோ அனுமதியளிக்க முடியும்.  எப்போதெனில் ஒரு குடிமகன் ஷரத் 12 முதல் ஷரத் 35 வரையுள்ள அடிப்படையுரிமைகள் பறிக்கும் போது இத்கைய ஆனைகள் வேண்டி முறையிடலாம்.

     ஒரு அரசு அல்லது அரசு அதிகாரியின் அல்லது அவர் அத்தகைய பணியில் இருக்கும் போது செய்யப்பட்ட செயல் அல்லது செய்ய வேண்டிய செயலுக்கு இத்தகைய ஆணையைப் பிறப்பிக்கலாம் - மேலும் விரிவாக அரசு என்ற பதம் ஷரத் 12ல் கூறப்பட்டுள்ளது.

   இந்த மனுக்களை நேரடியாக உயர்நீதிமன்றத்திலும் ‌(Article 226) அல்லது உச்ச நீதிமன்றத்திலும் (Article 32) தான் தாக்கல் செய்யமுடியும். மாவட்ட நீதிமன்ற ங்களில் அல்லது கிளை நிதிமன்றத்திலும் தாக்கல் செய்ய முடியாது. 

   உதாரணம் - ஒரு வணிகவரி அலுவலர் முறைக் கேடாக வரி வசூல் செய்கிறார் அல்லது பெறுகிறார் அப்போது அவருக்கு எதிராக இத்தகைய வழக்கை தொடுக்க முடியும்.

எப்போது இது ஆணையிடப்படும்.


1. ஒரு அரசு அதிகாரி சட்டத்தை மீறிச் செயல் படுகிறார்
2. ஒரு அரசு அதிகாரி தன் அதிகாரத்தை துஷ்பிரயோகிக்கிறார்
3. அவர் சட்டபடி அமைக்கப்பட்ட அரசின் கொள்கைக்கு மாறாக தவறான கொள்கை முலம் அரசை ஏமாற்றுகிறார் அல்லது அரசை குறைச் சொல்ல ஒரு காரனக் கார்த்தாவாக இருக்கிறார் ( mala fides )
4. அவர் தன்னுடைய மனநிலையில் இல்லை
5. அவர் தன்னுடைய பதவியை தன் விருப்படி எல்லாம் செய்கிறார் சட்டபடி செய்யாமல்
6. அவர் நெறிமுறைகளை எல்லாம் மீறி செயல் படுகிறார்
7. அவர் அநீதிக்கு எதுவான அனைத்தையும் தன் கவனத்தில் வைக்கிறார்

 

Mandamus is a judicial remedy in the form of an order from a superior court, to any government subordinate court, corporation, or public authority—to do (or forbear from doing) some specific act which that body is obliged under law to do (or refrain from doing)—and which is in the nature of public duty, and in certain cases one of a statutory duty. It cannot be issued to compel an authority to do something against statutory provision. For example, it cannot be used to force a lower court to reject or authorize applications that have been made, but if the court refuses to rule one way or the other then a mandamus can be used to order the court to rule on the applications.


 
      Mandamus may be a command to do an administrative action or not to take a particular action, and it is supplemented by legal rights. In the American legal system it must be a judicially enforceable and legally protected right before one suffering a grievance can ask for a mandamus. A person can be said to be aggrieved only when he is denied a legal right by someone who has a legal duty to do something and abstains from doing it.


“A writ of mandamus only issued to a public authority or a holder of a public office not to act contrary to any provision of a statute in the capacity of such holder of a public office. No such writ can be issued against a person whether an individual or a juristic per­son who purports to exercise a right by virtue of a claimed title to a certain property.”

A writ lies to a quasi-public body as, for example, the principal of a college maintained out of a public fund [Sekkilar v. Krishna Moorty, AIR 1952 Mad. 112]. A writ may also lie against a Univer­sity as it is a public body. [Hemendra Chandra Das v. Gohati University, AIR 1954 Assam 65].

Mandamus can also be issued to a Corporation with regard to its duty which is incumbent upon it in its corporate capacity. Article 226 expressly provides that a writ is avail­able against the Government also.

The writ of mandamus can be issued against a public authority in the following circumstances:-

1. where he has acted against the law ; or
2. where he has exceeded his limits of the powers; or
3. where he has acted with mala fides; or
4. where he has not applied his minds; or
5. where he abused his discretionary powers; or
6. where he has not taken into account of relavant consideration; or
7. where he is taken into account of irrelavant consideration; etc
