தினம் ஓரு உரிமை - தாழ்த்தப்பட்ட மற்றும் பழங்குடியினருக்கான உரிமை


இந்திய அரசியல் சாசனம் - 46




அரசு முக்கிய கவனம் செலுத்தி பொருளாதாரத்தில் நலிந்தப் பிற்பட்ட மக்களிடையே மேலும் குறிப்பாகத் தாழ்த்தப்பட்ட மற்றும் பழங்குடியின மக்களின் கல்வி மற்றும் பொருளாதார வளர்ச்சிக்கும் அதற்கான திட்டங்களை அமல்படுத்தவும் மிகுந்த அக்கறை எடுத்து அமல் படுத்த வேண்டும். அவர்களை சமுக அநீதியிலிருந்தும் மற்றும் எல்லா வகையான சுரண்டல்களில் இருந்தும் பாதுகாப்பளிக்கப்பட வேண்டும்.






Article 46.Promotion of educational and economic interests of Scheduled Castes, Scheduled Tribes and other weaker sections

 The State shall promote with special care the educational and economic interests of the weaker sections of the  people, and, in particular, of the Scheduled Castes and the Scheduled Tribes, and shall protect them from social injustice and all forms of exploitation.

[இந்திய அரசியல் சாசனம் துவங்கப்பட்டு பத்தாண்டு முடிவதற்குள் பதினான்கு வயது வரையுள்ள குழந்தைகள் அனைவருக்கும் இலவசமாகவும் கட்டாயமாகவும் கல்வி பெறுவதற்கான ஏற்பாடுகளை அரசு செய்ய வேண்டும்.]

        என்ற 45 வது ஷரத் 2002 ல் 86-வது அமர்வில் (Eighty-sixth Amendment) மாற்றம் செய்யப்பட்டது பின்வருமாறு 







       காலக் கெடு எதுவும் கூறிப்பிட வில்லை அது பின்னர் அறிவிக்கப்படுவதாக மாற்றப்பட்டது மேலும் கட்டாயம் என்ற பதமும் நீக்கப்பட்டது.Art. 45 shall stand substituted by the Constitution (Eighty-sixth Amendment) Act,
2002, s. 3 (which is yet not in force, date to be notified later on) as—

 


 இந்திய அரசியல் சாசனம் - 45 அரசானது குழந்தை பாதுகாப்பு மற்றும் குழந்தைக் களுக்கான கல்விக்கான வயது என்பதை ஆறு வயது வரை என மாற்றம் செய்யப்பட்டது. 

மேலும் இதை ஆங்கிலத்திலும் படிக்கும் மாறு தாழ்மையுடன் கேட்டுக் கொள்கிறேன். தமிழில் ஒரே பொருள் உள்ள வார்த்தைகள் நிறைய.



Article 45 - Provision for free and compulsory education for children


* [ Article 45.
 The State shall endeavour to provide, within a period of ten years from the commencement of this Constitution, for free and compulsory education for all children until they complete the age of fourteen years.]

Ins. by the Constitution (Forty-second Amendment) Act, 1976, s. 9 (w.e.f. 3-1-1977).


 

*Art. 45 shall stand substituted by the Constitution (Eighty-sixth Amendment) Act,
2002, s. 3 (which is yet not in force, date to be notified later on) as—

 

“45.  Provision for early childhood care and education to children below the
age of six years
.—The State shall endeavour to provide early childhood care and education
for all children until they complete the age of six years.”

தினம் ஓரு உரிமை - பொது உரிமையியல் சட்டம்





இந்திய அரசியல் சாசனம் - 44

 குடிமக்கள் அனைவருக்கும் ஒரே சீரான உரிமை இயல் சட்டத்தை இந்தியா முழுவதிலும் அமல் செய்யப்படுவதற்கான முயற்ச்சிகளை அரசு எடுக்க வேண்டும்.


பொது சிவில் சட்டம் என்றால் என்ன? பொது சிவில் சட்டம் வந்தால் சொத்துரிமை, தனிப்பட்ட உரிமைகளான திருமணம், விவாகரத்து, பராமரிப்பு, தத்து எடுத்தல் உள்ளிட்ட பல சட்ட உரிமைகள் எல்லோருக்கும் பொதுவாக இருக்கும். தற்போது உள்ள நிலையில் பல்வேறு வகுப்பினரையும் நிர்வாகம் செய்ய பல்வேறு சட்டங்கள் உள்ளன. பொது சிவில் சட்டம் அமல் செய்யப்பட்டால் இந்த தனி மதச் சட்டங்கள் அனைத்தும் ஒரே குடையின் கீழ் வந்துவிடும். இந்த சட்டங்கள் மத சார்பில்லாமல் அமையும். இந்தியாவில் உள்ள அனைத்து குடிமக்களுக்கும் அவர்கள் எந்த மதத்தினராக இருந்தாலும் அது பொருந்தும் வகையில் இருக்கும் .

தொழிற்சாலைகளை நடத்தும் அமைப்புகள் அல்லது நிறுவனங்கள் அல்லது நிர்வாகங்கள் அகியவற்றின் மேலாண்மைப் பணிகளில் தொழிலாளர்களுக்கும் பங்கு பெறுவதற்கான தக்க சட்டத்தை உருவாக்கி அல்லது வேறு எந்த வகையிலாவது அத்தகைய நடவடிக்கைகளை காணத்தக்க நடவடிக்கைகளை அரசு மேற்க்கொள்ள வேண்டும்.




Article 43A.

The State shall take steps, by suitable legislation or in any other way, to secure the participation of workers in the management of undertakings, establishments or other organisations engaged in any industry.

     அரசு தொழிளாளர் நலன் கருதி, ஒரு வேளாண்மை தொழிலில் அல்லது குடிசைத் தொழிலில் அல்லது  ஒரு தொழிற்சாலையில் அல்லது வேறு எதாவது தொழிலில்  ஈடுப்பட்டுள்ள தொழிளார்கள் அனைவருக்கும் வாழ்க்கை நடத்துவதற்கேதுவான ஊதியம், தொழில் முனைய எற்ற சூழ்நிலை, சரியான ஒய்வு , சமுக சார்ந்த அல்லது பண்பாடு சார்ந்த நிகழ்வுகளில் பங்கேற்கும் வாய்ப்பு ஆகியவற்றை தகுந்த சட்டத்தின் வாயிலாகவும் அல்லது பொருளாதார அமைப்புகள் முலமாகவும் உறுதிப்படுத்த வேண்டும்.


      மேலும் கிராமப்புறங்களில் கால்நடை சார்ந்த தொழில்கலையும், குடிசைத் தொழில்களையும் தனியார் முலமாகவோ அல்லது கூட்டுறவு மூலமாகவோ வளர்க்க தக்க முயற்ச்சிகளை எடுக்க வேண்டும்.





Article 43.

The State shall endeavour to secure, by suitable legislation or economic organisation or in any other way, to all workers, agricultural, industrial or otherwise, work, a living wage, conditions of work ensuring a decent standard of life and full enjoyment of leisure and social and cultural opportunities and, in particular, 





   the State shall endeavour to promote cottage industries on an individual or co-operative basis in rural areas.

அரசு நியமானதும் நிதியுமான மனித தன்மையுடன் கூடிய வேலை செய்யும் தொழில் நிலையங்களை உருவாக்க வேண்டும் மேலும் மகப்பேறு காலத்திற்கேற்ற உரிய உதவிகள் செய்யப்பட வழிவகைகள் காணப்பட வேண்டும்.

         ஒருவருடைய பொருளாதார வளர்ச்சிக்கும்  சக்திக்கும் ஏற்ற வேலைவாய்ப்பு கிடைப்பதற்கும், கல்விப் பயில வாய்ப்பு கிடைப்பதற்கும், வேலையில்லாத போதும் அல்லது முதிர்வயதுவுடையவருக்கும் அல்லது, நோய்வுற்றவருக்கும் அல்லது, ஊனமுற்றவருக்கும் மற்றும் வறுமையில் வாடுவோருக்கும் பொது நிதியிலிருந்து உதவி பெறுவதற்கு துனைபுரியவதற்கேற்ற வழிவகைகளை அரசு காண வேண்டும்.

தினம் ஓரு உரிமை - கிராம பஞ்சாயத்துக்கள் உருவாக்குதல்




ஷரத் 40.

கிராமப் பஞ்சாயத்துக்களை அமைப்பதற்குரிய நடவடிக்கைகளை அரசு மேற்க்கொள்ள வேண்டும். அந்தப் பஞ்சாயத்துக்கள் தன்னாட்சி பெற்ற அமைப்புகளாகச் செயல்படுவதற்கேற்ற வகையில் தேவைக்கு ஏற்ற அதிகாரங்களை அவற்றிற்கு வழங்கப்பட வேண்டும்.



Article 40. Organisation of village panchayats.

—The State shall take steps to organise village panchayats and endow them with such powers and authority as may be necessary to enable them to function as units of self-government.

Article 39A. Equal justice and free legal aid.

—The State shall secure that the operation of the legal system promotes justice, on a basis of equal opportunity, and shall, in particular, provide free legal aid, by suitable legislation or schemes or in any other way, to ensure that opportunities for securing justice are not
denied to any citizen by reason of economic or other disabilities.

தினம் ஓரு உரிமை - பொது நல வழக்கு


      PIL - Public Interest Litigation / SAL - Social Action Litigation  - பொது நல வழக்கு என்பதாகும் இது ஒரு புது வகையான நீதிப் பேராணையாகும் எந்த மனிதரும் அல்லது எந்த பொது நல அமைப்பும் இந்த ஆணையை வேண்டி நீதிமன்றத்தில் முறையிடலாம். பாதிக்கப்பட்ட மூன்றாவது நபருக்காக உதாரணமாக சொல்ல வேண்டுமானால் சூற்றுசூழல் சட்டம் (Environmental Law)  உருவானது இதனைஅடிப்படையாக கொண்டு தான். 


   தற்போது இந்த சட்டம் வேகமாக வளர்ந்து மனித உரிமை சட்டம், நுகர்வோர்  சட்டம், சிறைசாலை சட்டம், தொழிலாளர் நல சட்டம், குறைந்த ஊதிய உயர்வு சட்டம், சேம நல நீதி சட்டம், குழந்தை தொழிலாளர் சட்டம் மற்றும் முதியோர்கள் பெற்றோர் பாதுக்காப்பு சட்டம் என பல பரிணாமங்களை அடைந்துள்ளது.


மேலும் சில விவரங்கள்

       இவ்வழக்கின் முக்கிய சிறப்பம்சம். பாதிக்கப்பட்டவர், உயர் நீதிமன்றத்தில், 200 ரூபாய் செலுத்தி, பொது நல வழக்குக்கான மனுவை, தாக்கல் செய்யலாம்.பாதிக்கப்பட்ட நபர் அல்லது குழு, ஒரு அஞ்சல் அட்டை மூலம், பாதிக்கப்பட்ட விவரங்களை, உயர் நீதிமன்றத்திற்கு தெரிவித்தாலே, அது பொது நல வழக்காக ஏற்கப்படும். பத்திரிகை செய்திகளை அடிப்படையாக வைத்து, பாதிக்கப்பட்டவர்களுக்கு உரிய தீர்வு காண, உயர் நீதிமன்றமே தன்னிச்சையாகவும் வழக்கு தொடரும். வழக்கு தொடுக்கும் முன், மனுவின் நகல்களை பாதிப்பு ஏற்படுத்தியவருக்கு முறையாக அனுப்பி, அந்த ஆதாரத்தை, நீதிமன்ற மனுவுடன் இணைத்து, தாக்கல் செய்ய வேண்டும்.உயர் நீதிமன்றம், பாதிப்பு ஏற்படுத்தியவரை வரவழைத்து, இரு தரப்பு வாதங்களையும் கேட்டே, உரிய தீர்ப்பு வழங்கும். திருமண மண்டபம், கேளிக்கை விடுதி, பொது இடங்களில், அளவுக்கு மீறி அதிக ஒலி எழுப்பி பாதிப்பு ஏற்படுத்தும் போது, பொதுநல வழக்கு தொடுக்கலாம்.
தொழிற்சாலை கழிவுகளால், விஷவாயு வெளியேறுவது மற்றும் விவசாயம் பாதிக்கப்படுவது; குழந்தைகளை வேலைக்கு அமர்த்துவது; "திருமண திட்டம்' என்ற பெயரில், பெண்களுக்கு குறைந்த ஊதியம் வழங்குவது; கட்டுமான பணிகளுக்காக, சட்டத்திற்கு எதிராக பசுமை மரங்களை அழிப்பது; பொதுமக்கள் பாதிக்கும்படி, அதிக வரிகளை அரசு தன்னிச்சையாக அமல்படுத்தினாலும், பொதுநல வழக்கு தொடுக்கலாம்.மேலும், போக்குவரத்து நெரிசலை ஏற்படுத்தும் விளம்பர பலகைகளை அகற்ற; சிறைச் சாலைகளில் எவ்வித காரணமும், ஆதாரமும் இன்றி, காலவரையின்றி வாடும் சிறை கைதிகளை விடுவிக்க; உயர் பதவியில் இருக்கும் அதிகாரிகளின் லஞ்ச நடவடிக்கைகள் தொடர்பாகவும், பொதுநல வழக்கு தொடுக்கலாம்.

ஆனால் இதில் தற்போது நிறைய திருத்தங்கள் செய்யப்பட்டுள்ளது. சிலர் இந்த வழக்கை தங்களைப் பிரபலப்படுத்த பயன்படுத்துகின்றார்கள் என்பதால்.

அதனால் இதில் சில கட்டுப்பாடுகள் விதிக்கப்பட்டுள்ளது அவை பின் வருவன

1. வழக்கு தொடுப்பவர் வருமான வரி செலுத்துபவராக இருக்க வேண்டும்.

2. வழக்கு தொடுப்பவர் அவ்வாறு வருமான வரி செலுத்தும் பான் அட்டை இல்லை என்றால் தன்னுடைய வருமானத்துக்கான ஆதாரங்களை சமர்ப்பிக்க வேண்டும்.

3. வழக்குத் தொடுப்பவர் பிறருடைய வேண்டுதலால் அவ்வாறு செய்வாறாயின் அவருடைய வருமானத்துக்கான ஆதாரங்களை சமர்ப்பிக்க வேண்டும்.

இதற்கேன பல எதிர்ப்புக்கள் எழந்துள்ளன என்பது வேறு கதை.


இந்த  பொது நல வழக்கை சில சமயங்களில் உபயோகிக்க முடியாது தலையீட்டுரிமை (locus standi) இருக்கும் போது பொது நல வழக்கு சில சமயங்களில் தோற்றுவிடுகின்றது.

In Indian law, public interest litigation means litigation for the protection of the public interest. It is litigation introduced in a court of law, not by the aggrieved party but by the court itself or by any other private party.





Public-Interest Litigation is litigation for the protection of the public interest. In Indian law, Article 32 of the Indian constitution contains a tool which directly joins the public with judiciary. A PIL may be introduced in a court of law by the court itself (suo motu), rather than the aggrieved party or another third party. For the exercise of the court's jurisdiction, it is not necessary for the victim of the violation of his or her rights to personally approach the court. In a PIL, the right to file suit is given to a member of the public by the courts through judicial activism. The member of the public may be a non-governmental organization (NGO), an institution or an individual. 

   The Supreme Court of India, rejecting the criticism of judicial activism, has stated that the judiciary has stepped in to give direction because due to executive inaction, the laws enacted by Parliament and the state legislatures for the poor since independence have not been properly implemented.Subodh Markandeya well known Senior Advocate of Supreme court of India and Judicial activist believes that public interest litigation is the principal legal remedy For a common man and it is main weapon of judicial activist .

தினம் ஓரு உரிமை - locus standi - உள் தலையீட்டுரிமை




   locus standi ( loci standi ) - என்பது இலத்தின் வார்த்தையாகும் இதன் பொருள் வழக்கின் தலையீட்டுரிமை அல்லது உள் தலையீட்டுரிமை ஆகும்.  அதாவது ஒரு வழக்கில் மூன்றாவதாக ஒருவர் கொண்டாடும் உரிமை. 

       வாதி பிரதிவாதிகளுக்கிடையில் மூன்றாவதாக ஒருவர் தனக்கும் இதில் ஒரு உரிமை உண்டு என்று அறிவிக்கும் ஒரு வேண்டுதலாகும். இது ஒரு பொது நல வழக்குக்கு விடுவிப்பு (100% Exception)  ஆகும். இத்தகைய ஒரு வேண்டுதலை முன் வைக்கும் போது ஒரு பொது நல வழக்கு தள்ளுப்படி செய்யப்படுகின்றது. அல்லது செய்யப்படலாம் அல்லது இதனையும் சேர்த்து வழக்கை விசாரிக்கலாம்.





     ஆதாவது உதாரணமாக கத்தி படத்தில் விஜய் ஒரு பன்நாட்டு தொழிற்சாலை தன் கிராமத்தில் அமைக்க எதிர்ப்பு தெரிவித்து வழக்கு தொடுப்பார்.


  அதற்கு பிரதிவாதி வக்கில் இதில் உள்ளூர்  இளைய தலைமுறை பட்டதாரிகள் தொழிற்சாலைக்கு ஆதரவு தெரிவிப்பதாக கூறுவார்கள். அது தான்
உள் தலையீட்டுரிமை  (locus standi or loci standi )
ஆகும்.




      




 In law, locus standi means the right to bring an action, to be heard in court, or to address the Court on a matter before it. Locus standi is the ability of a party to demonstrate to the court sufficient connection to and harm from the law or action challenged to support that party’s participation in the case. For example, in the United States, a person cannot bring a suit challenging the constitutionality of a law unless the plaintiff can demonstrate that the plaintiff is (or will be) harmed by the law. 

   Otherwise, the court will rule that the plaintiff “lacks standing” to bring the suit, and will dismiss the case without considering the merits of the claim of unconstitutionality. In order to sue to have a court declare a law unconstitutional, there must be a valid reason for whoever is suing to be there. The party suing must have something to lose in order to sue unless they have automatic standing by action of law.

      PIL - Public Interest Litigation / SAL - Social Action Litigation  - பொது நல வழக்கு என்பதாகும் இது ஒரு புது வகையான நீதிப் பேராணையாகும் எந்த மனிதரும் அல்லது எந்த பொது நல அமைப்பும் இந்த ஆணையை வேண்டி நீதிமன்றத்தில் முறையிடலாம். பாதிக்கப்பட்ட மூன்றாவது நபருக்காக உதாரணமாக சொல்ல வேண்டுமானால் சூற்றுசூழல் சட்டம் (Environmental Law)  உருவானது இதனைஅடிப்படையாக கொண்டு தான். 


   தற்போது இந்த சட்டம் வேகமாக வளர்ந்து மனித உரிமை சட்டம், நுகர்வோர்  சட்டம், சிறைசாலை சட்டம், தொழிலாளர் நல சட்டம், குறைந்த ஊதிய உயர்வு சட்டம், சேம நல நீதி சட்டம், குழந்தை தொழிலாளர் சட்டம் மற்றும் முதியோர்கள் பெற்றோர் பாதுக்காப்பு சட்டம் என பல பரிணாமங்களை அடைந்துள்ளது.


மேலும் சில விவரங்கள்

       இவ்வழக்கின் முக்கிய சிறப்பம்சம். பாதிக்கப்பட்டவர், உயர் நீதிமன்றத்தில், 200 ரூபாய் செலுத்தி, பொது நல வழக்குக்கான மனுவை, தாக்கல் செய்யலாம்.பாதிக்கப்பட்ட நபர் அல்லது குழு, ஒரு அஞ்சல் அட்டை மூலம், பாதிக்கப்பட்ட விவரங்களை, உயர் நீதிமன்றத்திற்கு தெரிவித்தாலே, அது பொது நல வழக்காக ஏற்கப்படும். பத்திரிகை செய்திகளை அடிப்படையாக வைத்து, பாதிக்கப்பட்டவர்களுக்கு உரிய தீர்வு காண, உயர் நீதிமன்றமே தன்னிச்சையாகவும் வழக்கு தொடரும். வழக்கு தொடுக்கும் முன், மனுவின் நகல்களை பாதிப்பு ஏற்படுத்தியவருக்கு முறையாக அனுப்பி, அந்த ஆதாரத்தை, நீதிமன்ற மனுவுடன் இணைத்து, தாக்கல் செய்ய வேண்டும்.உயர் நீதிமன்றம், பாதிப்பு ஏற்படுத்தியவரை வரவழைத்து, இரு தரப்பு வாதங்களையும் கேட்டே, உரிய தீர்ப்பு வழங்கும். திருமண மண்டபம், கேளிக்கை விடுதி, பொது இடங்களில், அளவுக்கு மீறி அதிக ஒலி எழுப்பி பாதிப்பு ஏற்படுத்தும் போது, பொதுநல வழக்கு தொடுக்கலாம்.
தொழிற்சாலை கழிவுகளால், விஷவாயு வெளியேறுவது மற்றும் விவசாயம் பாதிக்கப்படுவது; குழந்தைகளை வேலைக்கு அமர்த்துவது; "திருமண திட்டம்' என்ற பெயரில், பெண்களுக்கு குறைந்த ஊதியம் வழங்குவது; கட்டுமான பணிகளுக்காக, சட்டத்திற்கு எதிராக பசுமை மரங்களை அழிப்பது; பொதுமக்கள் பாதிக்கும்படி, அதிக வரிகளை அரசு தன்னிச்சையாக அமல்படுத்தினாலும், பொதுநல வழக்கு தொடுக்கலாம்.மேலும், போக்குவரத்து நெரிசலை ஏற்படுத்தும் விளம்பர பலகைகளை அகற்ற; சிறைச் சாலைகளில் எவ்வித காரணமும், ஆதாரமும் இன்றி, காலவரையின்றி வாடும் சிறை கைதிகளை விடுவிக்க; உயர் பதவியில் இருக்கும் அதிகாரிகளின் லஞ்ச நடவடிக்கைகள் தொடர்பாகவும், பொதுநல வழக்கு தொடுக்கலாம்.

ஆனால் இதில் தற்போது நிறைய திருத்தங்கள் செய்யப்பட்டுள்ளது. சிலர் இந்த வழக்கை தங்களைப் பிரபலப்படுத்த பயன்படுத்துகின்றார்கள் என்பதால்.

அதனால் இதில் சில கட்டுப்பாடுகள் விதிக்கப்பட்டுள்ளது அவை பின் வருவன

1. வழக்கு தொடுப்பவர் வருமான வரி செலுத்துபவராக இருக்க வேண்டும்.

2. வழக்கு தொடுப்பவர் அவ்வாறு வருமான வரி செலுத்தும் பான் அட்டை இல்லை என்றால் தன்னுடைய வருமானத்துக்கான ஆதாரங்களை சமர்ப்பிக்க வேண்டும்.

3. வழக்குத் தொடுப்பவர் பிறருடைய வேண்டுதலால் அவ்வாறு செய்வாறாயின் அவருடைய வருமானத்துக்கான ஆதாரங்களை சமர்ப்பிக்க வேண்டும்.

இதற்கேன பல எதிர்ப்புக்கள் எழந்துள்ளன என்பது வேறு கதை.


இந்த  பொது நல வழக்கை சில சமயங்களில் உபயோகிக்க முடியாது தலையீட்டுரிமை (locus standi) இருக்கும் போது பொது நல வழக்கு சில சமயங்களில் தோற்றுவிடுகின்றது.

In Indian law, public interest litigation means litigation for the protection of the public interest. It is litigation introduced in a court of law, not by the aggrieved party but by the court itself or by any other private party.





Public-Interest Litigation is litigation for the protection of the public interest. In Indian law, Article 32 of the Indian constitution contains a tool which directly joins the public with judiciary. A PIL may be introduced in a court of law by the court itself (suo motu), rather than the aggrieved party or another third party. For the exercise of the court's jurisdiction, it is not necessary for the victim of the violation of his or her rights to personally approach the court. In a PIL, the right to file suit is given to a member of the public by the courts through judicial activism. The member of the public may be a non-governmental organization (NGO), an institution or an individual. 

   The Supreme Court of India, rejecting the criticism of judicial activism, has stated that the judiciary has stepped in to give direction because due to executive inaction, the laws enacted by Parliament and the state legislatures for the poor since independence have not been properly implemented.Subodh Markandeya well known Senior Advocate of Supreme court of India and Judicial activist believes that public interest litigation is the principal legal remedy For a common man and it is main weapon of judicial activist .

தினம் ஓரு உரிமை - Certiorari - நெறிமுறை உறுத்தும் நீதிப் பேராணை



    Certiorari (certioro, certiorare) என்பது இலத்தின் வார்த்தையாகும் இதன் பொருள் கூறுதல் அல்லது தெரிவித்தல் அல்லது ஆவணங்களை காட்டுதல் என்பதாகும்.  ஆங்கிலத்தில் இதனை to inform, apprise,  show or to be certified என்றும் கூறுவார்கள்.






             இந்த ஆணையின் கீழ் நீதிமன்றங்கள் தனக்கு கீழ் உள்ள நீதி மன்றத்துக்கோ அல்லது குவாசி நீதிமன்றத்துக்கோ அல்லது தீர்பாயத்துக்கோ அல்லது சட்ட ரீதியான ஒரு அமைப்பு சட்டப்பிரச்சனை களை களைவதற்கு அமைக்கப்பட்டுள்ளது அதனை இந்த உத்தரவு கட்டுப்படுத்தலாம். எவ்வாறு எனி்ல் அந்த சட்ட தீர்பபுகளில் தவறான ஒரு முன் உதாரணத்தை உட்படுத்துவது அல்லது ஒரு தவறான ஆவணத்தின் அடிப்படையில் தீர்ப்பளிக்கும் போதும் அல்லது குடிமக்களின் அடிப்படை உரிமையை பறிக்கும் போதும்.

இந்த  நெறிமுறை உறுத்தும் நீதிப் பேராணை பயன் படுத்தலாம்

உதாரணம் - ஒரு கோட்டாச்சியருக்கு ஒருவர் தன் தாயை கவனிக்கவில்லை தன் சகோதரர் என்று ஒரு சகோதரி கோரிக்கை விடுக்கின்றார். அதனால் அவரின் சொத்தை தன் தாயின் பெயரிலோ அல்லது தன் பெயரிலோ மாற்ற வேண்டும் என்று கோருகிறார்.  அந்த கோட்டாச்சியரும் அதனை தீர விசாரிக்காமல் ஒரு தீர்ப்பை வழங்குகிறார் அல்லது அத்தகைய மகனின் சொத்தை கைப்பற்ற ஒரு ஆணையிடுகிறார். இது ஒரு தவறான முன் உதாரணமாகும். அந்த அலுவலர் தன்னிடம் அளிக்கப்பட்ட புகாரின் தன்மையை அறிந்தப்பின் அதனை தீர புலன்விசாரனை செய்ய வேண்டும். செய்யாமல் இத்தகைய நடவடிக்கைகள் தவறான முன் உதாரணங்களாகும். இந்த சமயங்களில் இந்த  நெறிமுறை உறுத்தும் நீதிப் பேராணை பயன் படுத்தலாம்.  (இதனை suo moto என்ற அதிகாரத்தை தவறாக பயன் படுத்துவதாகும்)




மேலும் ஒரு வழக்கு தமிழகத்தில்

அன்பழகன் எதிர் கோட்டாச்சியர் கிருஷ்ணகிரி

வழக்கின் சுருக்கம் பெற்றோரை கவனிக்காத பிள்ளையின் சொத்தை - அதாவது அந்த சொத்து அவரின் பெற்றோரிடமிருந்து பெற்று இருக்கம் பட்சத்தில் அதனை அவருக்கே கொடுக்க வேண்டும் என
கோட்டாச்சியர் கிருஷ்ணகிரி  ஆணையிடுகிறார். அது அவ்வாறே நீதி மன்றத்தில் தீர்ப்பாகிறது.

    இதைப் பயன்படுத்துவது எப்போதெனில்








1. ஒரு சட்ட அமைப்பு (Quasi-Judicial) தவறான சட்டத்தை பயன் படுத்தும் போதும்.

2. ஒரு நீதிமன்றம் அல்லது அமைப்பு சட்ட முறையின்றி செயல்படும் போதும்.

3. ஒரு பிழையுடன் கூடிய ஒரு ஆவணத்தை சாட்சியமாக பயன்படுத்தி தீர்ப்பளிக்கும் போதும்.

4. ஒரு நீதி மன்றம் அல்லது  சட்ட அமைப்பு (Quasi-Judicial) ஒரு தீர்ப்பை அடிப்படை உரிமைக்கு எதிராக வழங்கும் போதும்.

5.  ஒரு நீதி மன்றம் அல்லது  சட்ட அமைப்பு (Quasi-Judicial) ஒரு தீர்ப்பை நீதிக்கு எதிராக வழங்கும் போதும்.

6. இந்த ஆணையை ஒரு தனி மனிதருக்கும் (private person) அல்லது தனியார் நிறுவனத்தும் (private form or private company)  ஆணையிட முடியாது 

7. இந்த ஆணையை ஒரு சட்ட மன்றத்துக்கும் (legislature) அல்லது செயல்படுத்தும்(executive) ஒரு ஆனையத்துக்கு இட முடியாது.

Writ of Certiorari
     It is a writ (order) of a higher court to a lower court to send all the documents in a case to it so the higher court can review the lower court’s decision.  Appellate review of a case that is granted by the issuance of certiorari is sometimes called an appeal, although such review is at the discretion of the appellate court. A party, the petitioner, files a petition for certiorari with the appellate court after a judgment has been rendered against him in the inferior court.



     

      However, unlike a writ of prohibition, superior courts issue writs of certiorari to review decisions which inferior courts have already made. The writ of prohibition is the counterpart of the writ to certiorari which too is issued against the action of an inferior court.

     The difference between the two was explained by Justice
 Venkatarama Ayyar of the Supreme Court in the following terms:


      “When an inferior court takes up for hearing a matter over which it has no jurisdiction, the person against whom the proceedings are taken can move the superior court for a writ of prohibition and on that an order will issue forbidding the inferior court from continuing the proceedings. On the other hand, if the court hears the cause or matter and gives a decision, the party aggrieved would have to move the superior court for a writ of certiorari and on that an order will be made quashing the decision on the ground of want of jurisdiction.”

When Can the Writ of Certiorari be issued !?

1. Where the quasi-judicial authority acted under an invalid law.

2. Where the court or authority acted with out jurisdiction.

3. Where there is an error of law apparent on the face of the record.

4. Where the inferior court or quasi court-authority acted agaist the principles of natural justice;

5. Where the inferior court or quasi court-authority against fundamental rules;

6. This Writ cannot be issued agaist private person or private company

7.  It cannot be issued against legislature or executive.

    Prohibitio (Prohibit) என்பது இலத்தின் வார்த்தையாகும் இதன் பொருள் தடைவிதித்தல் அல்லது நிறுத்திவைத்தல் என்பதாகும்.  ஆங்கிலத்தில் இதனை Prohibit அதனை Prohibition என்றும் கூறுவார்கள்.



             இந்த ஆணையின் கீழ் நீதிமன்றங்கள் தனக்கு கீழ் உள்ள நீதி மன்றத்துக்கோ அல்லது குவாசி நீதிமன்றத்துக்கோ அல்லது தீர்பாயத்துக்கோ ஒரு 
ஆணையிட்டு நடைபெற இருக்கும் ஒரு சட்டரீதியான விசாரணையை அல்லது சட்ட ரீதியான தீர்ப்பை நிறுத்தவோ அல்லது நடைபெற்றுக் கொண்டிருக்கும் ஒரு காரியம் அல்லது செயலை நிறுத்த முடியும்.  



    எப்போதெனில் 

1 . ஒரு குடிமகன் ஷரத் 12 முதல் ஷரத் 35 வரையுள்ள அடிப்படையுரிமை பறிக்கும் போது இந்த நீதிப்பேரணை வேண்டி முறையிடலாம். 

2. தனக்கு கீழ் உள்ள நீதிமன்றம் தனக்குள்ள வரம்பை மீறும்போது

3. தனக்கு கீழ் உள்ள நீதிமன்றம் - நீதி அல்லது தீர்ப்பை சரியாக சரியாக நடைமுறைப்படுத்தாதப் போது

4. ஒரு தவறான பதிவு உள்ள அறிக்கை அல்லது சான்றை மையமாக வைத்து தீர்ப்பளிக்கும் போதும்.







Writ of Prohibition:
 
    A writ of prohibition is issued primarily to prevent an inferior court from exceeding its jurisdiction, or acting contrary to the rule of natural justice, for example, to restrain a Judge from hearing a case in which he is personally interested.

     The term “inferior courts” comprehends special tribunals, commissions, magistrates and officers who exercise judicial powers, affecting the property or rights of the citizen and act in a summary way or in a new course different from the common law. It is well established that the writ lies only against a body exercising public functions of a judicial or quasi- judicial character and cannot in the nature of things be utilised to restrain legislative powers.
 


        These Writs are issued as “alternative” or “peremptory.” An alternative Writ directs the recipient to immediately act, or desist, and “Show Cause” why the directive should not be made permanent. A peremptory Writ directs the recipient to immediately act, or desist, and “return” the Writ, with certification of its compliance, within a certain time.

       The writ can be issued only when the proceedings are pending in a court if the proceeding has matured into decision, writ will not lie.



When Can be a Writ of Prohibition be granded !?

1. Where the inferior court exceeds its jurisdiction.
2. Where the inferior court acts without its jurisdiction.
3. Where the principles of  Natural Justice are violated.
4. Where the fundamental rights of a person are violated.
5. Where the error apparent on the face of the record is considered.

தினம் ஓரு உரிமை - Quo Warranto - தகுதிமுறை வினவும் நீதிப்பேரணை



           Quo Warranto (கோ வாரண்டோ) என்பது இலத்தின் வார்த்தையாகும் இதன் பொருள் எந்த அதிகாரத்தில் என்ற தகுதிமுறை வினவுதல்  ஆகும். அல்லது ஆங்கிலத்தில் By what warrant? அல்லது What is your Authority? என்பதாகும்.  

        Quo warranto functioned as a court order (or "writ") to show proof of authority; for example, demanding that someone acting as the sheriff prove that the king had actually appointed him to that office (literally, "By whose warrant are you the sheriff?"). 

     இங்கிலாந்து நாட்டில் இந்த நீதிப்பேரணை செயல் பட ஆரம்பித்தது எப்போது என்றால் ஒருவர் ஒரு அதிகாரியாக செயல்பட்டு ஒரு செயலை செய்கிறார் அதற்கு ராஜாவின் உத்தரவின்படிதான் அவர் அவ்வாறு செயல்படுகின்றாரா அல்லது தன் சொந்த விருப்பத்தின் பேரில் செய்கின்றாரா என்பதை வினவ இந்த ஆணை பழங்காலத்தில் இங்கிலாந்து நாட்டில் பயன்படுத்தப்பட்டது. காலப் போக்கில் அது ஒரு நீதிப் பேராணையாவே மாறியது. அது நம்மை ஆண்ட ஆங்கிலேயரிடமிருந்து நம் நாட்டின் வசமானது. நம் நாட்டில் இன்றும் வழக்கில் உள்ள ஒரு நீதிப் பேராணையாகும்.




             இந்த ஆணையின் கீழ் நீதிமன்றங்கள் ஒரு ஆணையின் வாயிலாக தமக்கு கீழ் உள்ள ஒரு மன்றத்தையோ அல்லது அரசு அலுவலகத்தையோ அல்லது அரசு அதிகாரியை அல்லது ஆனையத்தையோ தகுதி முறையை வினவமுடியும்.   எப்போதெனில் ஒரு குடிமகன் ஷரத் 12 முதல் ஷரத் 35 வரையுள்ள அடிப்படையுரிமை பறிக்கும் போது இந்த நீதிப்பேரணை வேண்டி முறையிடலாம். 

குறிப்பாக இந்த ஆணையை ஒரு பொது ஊழியர் நோக்கி பணிக்கலாம்.  எவ்வாறேனில் அவர் அந்த பதவி வகிக்க அனுமதியளிக்காத போது அவர் தவறுதலாக அந்த பதவியை வகிக்கிறார் அல்லது அவர் ஒரு செயலை செய்ய அனுமதியில்லை என தெரிந்து செய்கிறார் அல்லது அவர் அந்த பணிக்கு பொருத்தமானவர் இல்லை சரியான நபரை அந்த பதவியில் அமர்த்த இந்த ஆணையை பணிக்கலாம்.





            இந்த மனுக்களை நேரடியாக உயர்நீதிமன்றத்திலும் ‌(Article 226) அல்லது உச்ச நீதிமன்றத்திலும் (Article 32) தான் தாக்கல் செய்யமுடியும். மாவட்ட நீதிமன்ற ங்களில் அல்லது கிளை நிதிமன்றத்திலும் தாக்கல் செய்ய முடியாது.




 எப்போது இந்த ஆணையிடப்படும்.


1. இந்த ஆணை ஒரு அரசு அலுவலகம் ஒரு தனித்து இயங்கும் அரசு அலுவலகம் அல்லது அரசு துனையுடன் இயங்கும் அரசு அலுவலகம் பணிக்கலாம் மேலும் ஒரு தனி மனிதரையோ அல்லது தனியார் நிர்வாகத்தையோ பணிக்க முடியாது.

2. இதை ஒரு ஒழுங்குக்காக ஒரு பொது வழக்காக கொண்டு Quo Warranto வேண்டி முறையிடலாம் ஆனால் இந்த வழக்கை ஒரு தனி மனிதனின் தொல்லை அல்லது கோபம் உண்டாக்கும் செயலுக்காக அனுக முடியாது. இதற்கு Locus Standi  தேவையற்றதாக இருக்கும்.

3. அந்த அலுவலகம் ஒரு நீதி மன்றமாகவும் அல்லது அரசு சார்ந்ததாகவும் இருக்கம் ஆனால் ஒரு தனியார் அலுவலகத்தை அல்ல.

4. இந்த ஆணையை ஒரு அரசு அலுவலகம் இடும் அந்த அலுவலகம் பிரதமர் அல்லது முதல்வர் அல்லது அட்வகேட் ஜெனரல் அல்லது  உயர் நீதிமன்ற நீதிபதி அல்லது ஒரு ஜீல்லா பிரசிடன்ட் அல்லது பாரளுமன்ற சபாநாயகர் அல்லது சட்டமன்ற சபாநாயகர் அலுவலகமாகவோ அல்லது பல்கலைக்கழக அலுவலகமாகவோ இருக்கும். அரசு அலுவலகம் என்பது ஷரத் 12 விளக்கப்பட்டுள்ளது. 




              Quo warranto had its origins in an attempt by King Edward I of England to investigate and recover royal lands, rights, and franchises in England,[1] in particular those lost during the reign of his father, King Henry III of England.[2][3] From 1278 to 1294, Edward dispatched justices throughout the Kingdom of England to inquire “by what warrant” English lords held their lands and exercised their jurisdictions (often including the right to hold a court and collect its profits). 

Initially, the justices demanded written proof in the form of charters, but resistance and the unrecorded nature of many grants forced Edward to accept those rights peacefully exercised since 1189.[1][4] Later, quo warranto functioned as a court order (or "writ") to show proof of authority; for example, demanding that someone acting as the sheriff prove that the king had actually appointed him to that office (literally, "By whose warrant are you the sheriff?").




            The most famous historical instance of quo warranto was the action taken against the Corporation of London by Charles II in 1683.[5] The King's Bench adjudged the charter and franchises of the city of London to be forfeited to the Crown, though this judgment was reversed by the London, Quo Warranto Judgment Reversed Act 1689 shortly after the Glorious Revolution.

(1) Notwithstanding anything in Article 32 every High Court shall have powers, throughout the territories in relation to which it exercise jurisdiction, to issue to any person or authority, including in appropriate cases, any Government, within those territories directions, orders or writs, including writs in the nature of habeas corpus, mandamus, prohibitions, quo warranto and certiorari, or any of them, for the enforcement of any of the rights conferred by Part III and for any other purpose 
A writ of quo warranto is not a petition, but a notice of demand, issued by a demandant, to a respondant claiming some delegated power, and filed with a court of competent jurisdiction, to hold a hearing within 3 to 20 days, depending on the distance of the respondant to the court, to present proof of his authority to execute his claimed powers. If the court finds the proof insufficient, or if the court fails to hold the hearing, the respondant must cease to exercise the power. If the power is to hold an office, he must vacate the office.

The writ is unlike a petition or motion to show cause, because the burden of proof is on the respondant, not on the demandant.

By itself, the writ does not seek the support of the court to order the respondant to cease the exercise or vacate the office. That would be an accompanying writ of prohibito or a writ of mandamus. All such writs contemplate enforcement by the people as militia, although that could include the sheriff or constable as commander of militia. The right involved is that of the respondant to present his evidence.

These writs are called prerogative writs because they are supposed to be docketed ahead of all other cases except other prerogative writs. The demandant represents the sovereign, the people, and anyone may appear in that capacity, even without a personal stake in the decision.

A writ of habeas corpus may be regarded as a subset of quo warranto, for cases where the claimed power is to hold a prisoner, but with the addition of a requirement to produce the prisoner in court, not just appear to present evidence of authority.

The prerogative writ of quo warranto has been suppressed at the federal level in the United States, and deprecated at the state level, but remains a right under the Ninth Amendment, which was understood and presumed by the Founders, and which affords the only judicial remedy for violations of the Constitution by public officials and agents. Here are a few writings on the subject. Revival of the writs must be combined with reviving standing for private prosecution of public rights, subverted by the "cases and controversies" doctrine and the decision in Frothingham v. Mellon, 262 U.S. 447 (1923), which is discussed in an article by Steve Winter, The Metaphor of Standing and the Problem of Self-Governance.

Although some of these writings are copyrighted, we are assured that all the chapters of all the ones still copyrighted have been attached to pleadings in various cases, and thus made part of the public record, thereby putting them into the public domain.

A critical key to achieving federal constitutional compliance is to resurrect quo warranto and other common law writs. This involves reasserting and strengthening the original All-Writs Act and repealing or declaring unconstitutional legislation, such as the Tax Anti-Injunction Act, and those Rules of Judicial Procedure, that have restricted the jurisdiction of federal courts to accept these writs and grant a fair hearing ("oyer") and a decision on the merits ("terminer") on such demands.


When Can the Writ of Quo Warranto be Issued !?

1. The Office must be public office.

2. That Office must an independent and substantive character

3. The Public office must be statutory or constitutional

4. This Writ can be issued in respect of offices of the Prime Minister, Chief Minister, Advocate General, Judge of a High Court, President of Zilla Parishad, Speaker of the Parliment or State Legislate , University officials, etc. The Public Office is defined in Article 12 of the indian constitution.

5. That the holder of that office must have asserted his claim to the office which he is holding

6. No locas standi is necessary, It may be raised as a Public Interested Litigation.


When Cannot be The Writ of Quo Warranto be issued !?

1. This writ cannot be issued of a private person, such as Partnership forms or a company.

2. If the petition is seemed to have been filed for harassing or is of vexatious nature , this writ is not issued (Case-law S.P.ANAND v/s Deve Howda, Prime minister).

3. Where there is a sufficient delay or latch on the part of the petitioner  ; this writ is not available.

4. where there is an alternative remedy available for the petitioner, this writ is not available.

5. Its purely depended upon the discretionary of the court , The Cout after considering the facts and circumstamces of the cases, if its believes that there are ni genuine grounds on the part of the petitioner, then the court may refuse to issue of this writ.

6. Functus Officio, When the public office ceases to function, example it becomes functus officio, then the writ of Quo Warranto cannot be issued, as there is no use of it in that circumstance

7. Thomus C.V.C : A Public interested litigation, by way of writ of Quo Warranto was filed against Thomas C.V.C alleging that he was involved in the criminal cases while he was working in kerala, While the Case was under pending in the UPA Government asked him to resign the post. He is refused to do so. The UPA Government removed him and appointed another person.
