RULES ON AN ADVOCATE’S DUTY TOWARDS THE CLIENT

1. Bound to accept briefs
An advocate is bound to accept any brief in the courts or tribunals or before any other authority in or before which he proposes to practise. He should levy fees which is at par with the fees collected by fellow advocates of his standing at the Bar and the nature of the case. Special circumstances may justify his refusal to accept a particular brief.

2. Not withdraw from service
An advocate should not ordinarily withdraw from serving a client once he has agreed to serve them. He can withdraw only if he has a sufficient cause and by giving reasonable and sufficient notice to the client. Upon withdrawal, he shall refund such part of the fee that has not accrued to the client.

3. Not appear in matters where he himself is a witness
An advocate should not accept a brief or appear in a case in which he himself is a witness. If he has a reason to believe that in due course of events he will be a witness, then he should not continue to appear for the client. He should retire from the case without jeopardising his client’s interests.

4. Full and frank disclosure to client
An advocate should, at the commencement of his engagement and during the continuance thereof, make all such full and frank disclosure to his client relating to his connection with the parties and any interest in or about the controversy as are likely to affect his client’s judgement in either engaging him or continuing the engagement.

5. Uphold interest of the client
It shall be the duty of an advocate fearlessly to uphold the interests of his client by all fair and honourable means. An advocate shall do so without regard to any unpleasant consequences to himself or any other. He shall defend a person accused of a crime regardless of his personal opinion as to the guilt of the accused. An advocate should always remember that his loyalty is to the law, which requires that no man should be punished without adequate evidence.

6. Not suppress material or evidence
An advocate appearing for the prosecution of a criminal trial should conduct the proceedings in a manner that it does not lead to conviction of the innocent. An advocate shall by no means suppress any material or evidence, which shall prove the innocence of the accused.

7. Not disclose the communications between client and himself
An advocate should not by any means, directly or indirectly, disclose the communications made by his client to him. He also shall not disclose the advice given by him in the proceedings. However, he is liable to disclose if it violates Section 126 of the Indian Evidence Act, 1872.

8. An advocate should not be a party to stir up or instigate litigation.


9. An advocate should not act on the instructions of any person other than his client or the client’s authorised agent.

10. Not charge depending on success of matters

An advocate should not charge for his services depending on the success of the matter undertaken. He also shall not charge for his services as a percentage of the amount or property received after the success of the matter.

11. Not receive interest in actionable claim
An advocate should not trade or agree to receive any share or interest in any actionable claim. Nothing in this rule shall apply to stock, shares and debentures of government securities, or to any instruments, which are, for the time being, by law or custom, negotiable or to any mercantile document of title to goods.

12. Not bid or purchase property arising of legal proceeding
An advocate should not by any means bid for, or purchase, either in his own name or in any other name, for his own benefit or for the benefit of any other person, any property sold in any legal proceeding in which he was in any way professionally engaged. However, it does not prevent an advocate from bidding for or purchasing for his client any property on behalf of the client provided the Advocate is expressly authorised in writing in this behalf.

13. Not bid or transfer property arising of legal proceeding
An advocate should not by any means bid in court auction or acquire by way of sale, gift, exchange or any other mode of transfer (either in his own name or in any other name for his own benefit or for the benefit of any other person), any property which is the subject matter of any suit, appeal or other proceedings in which he is in any way professionally engaged.

14. Not adjust fees against personal liability
An advocate should not adjust fee payable to him by his client against his own personal liability to the client, which does not arise in the course of his employment as an advocate.

15.An advocate should not misuse or takes advantage of the confidence reposed in him by his client.

16.Keep proper accounts
An advocate should always keep accounts of the clients’ money entrusted to him. The accounts should show the amounts received from the client or on his behalf. The account should show along with the expenses incurred for him and the deductions made on account of fees with respective dates and all other necessary particulars.

17. Divert money from accounts
An advocate should mention in his accounts whether any monies received by him from the client are on account of fees or expenses during the course of any proceeding or opinion. He shall not divert any part of the amounts received for expenses as fees without written instruction from the client.

18. Intimate the client on amounts
Where any amount is received or given to him on behalf of his client, the advocate must without any delay intimate the client of the fact of such receipt.

19. Adjust fees after termination of proceedings
An advocate shall after the termination of proceedings, be at liberty to adjust the fees due to him from the account of the client. The balance in the account can be the amount paid by the client or an amount that has come in that proceeding. Any amount left after the deduction of the fees and expenses from the account must be returned to the client.

20. Provide copy of accounts
An advocate must provide the client with the copy of the client’s account maintained by him on demand, provided that the necessary copying charge is paid.

21. An advocate shall not enter into arrangements whereby funds in his hands are converted into loans.

22. Not lend money to his client
An advocate shall not lend money to his client for the purpose of any action or legal proceedings in which he is engaged by such client. An advocate cannot be held guilty for a breach of this rule, if in the course of a pending suit or proceeding, and without any arrangement with the client in respect of the same, the advocate feels compelled by reason of the rule of the Court to make a payment to the Court on account of the client for the progress of the suit or proceeding.

23. Not appear for opposite parties
An advocate who has advised a party in connection with the institution of a suit, appeal or other matter or has drawn pleadings, or acted for a party, shall not act, appear or plead for the opposite party in the same matter.

RULES ON AN ADVOCATE’S DUTY TOWARDS THE COURT


1. Act in a dignified manner
During the presentation of his case and also while acting before a court, an advocate should act in a dignified manner. He should at all times conduct himself with self-respect. However, whenever there is proper ground for serious complaint against a judicial officer, the advocate has a right and duty to submit his grievance to proper authorities.

2. Respect the court
An advocate should always show respect towards the court. An advocate has to bear in mind that the dignity and respect maintained towards judicial office is essential for the survival of a free community.

3. Not communicate in private
An advocate should not communicate in private to a judge with regard to any matter pending before the judge or any other judge. An advocate should not influence the decision of a court in any matter using illegal or improper means such as coercion, bribe etc.

4. Refuse to act in an illegal manner towards the opposition
An advocate should refuse to act in an illegal or improper manner towards the opposing counsel or the opposing parties. He shall also use his best efforts to restrain and prevent his client from acting in any illegal, improper manner or use unfair practices in any mater towards the judiciary, opposing counsel or the opposing parties.

5. Refuse to represent clients who insist on unfair means

An advocate shall refuse to represent any client who insists on using unfair or improper means. An advocate shall excise his own judgment in such matters. He shall not blindly follow the instructions of the client. He shall be dignified in use of his language in correspondence and during arguments in court. He shall not scandalously damage the reputation of the parties on false grounds during pleadings. He shall not use unparliamentary language during arguments in the court.

6. Appear in proper dress code
An advocate should appear in court at all times only in the dress prescribed under the Bar Council of India Rules and his appearance should always be presentable.

7. Refuse to appear in front of relations
An advocate should not enter appearance, act, plead or practice in any way before a judicial authority if the sole or any member of the bench is related to the advocate as father, grandfather, son, grandson, uncle, brother, nephew, first cousin, husband, wife, mother, daughter, sister, aunt, niece, father-in-law, mother-in-law, son-in-law, brother-in-law daughter-in-law or sister-in-law.

8. Not to wear bands or gowns in public places
An advocate should not wear bands or gowns in public places other than in courts, except on such ceremonial occasions and at such places as the Bar Council of India or as the court may prescribe.

9. Not represent establishments of which he is a member
An advocate should not appear in or before any judicial authority, for or against any establishment if he is a member of the management of the establishment. This rule does not apply to a member appearing as “amicus curiae” or without a fee on behalf of the Bar Council, Incorporated Law Society or a Bar Association.

10. Not appear in matters of pecuniary interest
An advocate should not act or plead in any matter in which he has financial interests. For instance, he should not act in a bankruptcy petition when he is also a creditor of the bankrupt. He should also not accept a brief from a company of which he is a Director.

11. Not stand as surety for client
An advocate should not stand as a surety, or certify the soundness of a surety that his client requires for the purpose of any legal proceedings.

RULES ON ADVOCATE’S DUTY TO OPPONENTS

1. Not to negotiate directly with opposing party
An advocate shall not in any way communicate or negotiate or call for settlement upon the subject matter of controversy with any party represented by an advocate except through the advocate representing the parties.

2. Carry out legitimate promises made
An advocate shall do his best to carry out all legitimate promises made to the opposite party even though not reduced to writing or enforceable under the rules of the Court.

RULES ON AN ADVOCATE’S DUTY TOWARDS FELLOW ADVOCATES


1. Not advertise or solicit work
An advocate shall not solicit work or advertise in any manner. He shall not promote himself by circulars, advertisements, touts, personal communications, interviews other than through personal relations, furnishing or inspiring newspaper comments or producing his photographs to be published in connection with cases in which he has been engaged or concerned.

2. Sign-board and Name-plate
An advocate’s sign-board or name-plate should be of a reasonable size. The sign-board or name-plate or stationery should not indicate that he is or has been President or Member of a Bar Council or of any Association or that he has been associated with any person or organisation or with any particular cause or matter or that he specialises in any particular type of work or that he has been a Judge or an Advocate General.

3. Not promote unauthorized practice of law
An advocate shall not permit his professional services or his name to be used for promoting or starting any unauthorised practice of law.

4. An advocate shall not accept a fee less than the fee, which can be taxed under rules when the client is able to pay more.


5. Consent of fellow advocate to appear

An advocate should not appear in any matter where another advocate has filed a vakalt or memo for the same party. However, the advocate can take the consent of the other advocate for appearing.
In case, an advocate is not able to present the consent of the advocate who has filed the matter for the same party, then he should apply to the court for appearance. He shall in such application mention the reason as to why he could not obtain such consent. He shall appear only after obtaining the permission of the Court.

        யாராவது சட்டவிரோதமான ஒரு கூட்டம் கலகம் செய்கின்றது எனத் தெரிந்தும்.., அந்தக் கூட்டத்தின் கலகம் அந்த இடத்தின் உரிமையாளருக்கு ஆதரவாகவோ அல்லது இடத்தின் உரிமையாளருக்கு உரிய உரிமையைப் பெற்றுத்தர நடைப்பெற்றாலும் அல்லது அத்தகைய கலகத்தின் மூலம் அந்த இடத்தின் உரிமையாளருக்கு சாதமாக ஒரு செயல் அல்லது அந்த இடத்தின் உரிமையாளரின் லாபத்திற்காக நடைப்பெற்றாலும் அதனை அந்த இடத்தின் உரிமையாளர் அனுமதிப்பது குற்றமாகும்.

         அந்த இடத்தின் சொந்தக்காரர் அதனைத் தடுப்பதற்கு தேவையான நடவடிக்கைகளை எடுக்கவேண்டும். அப்படி அந்த இடத்தின் சொந்தக்காரர் இல்லையென்றால் அவருடைய பிரதிநிதி அல்லது இடத்தின் உரிமையாளரின் மேலாளர் அந்த சட்டவிரோதமான கூட்டத்தை அடக்குவதற்கு தேவையான நடவடிக்கை எடுக்கவில்லை என்றால் அவருக்கும் அபராதம் விதிக்கப்படும்.


Section 155- Liability of person for whose benefit riot is committed
 
                 Whenever a riot is committed for the benefit or on behalf of any person who is the owner or occupier of any land, respecting which such riot takes place or who claims any interest in such land, or in the subject of any dispute which gave rise to the riot, or who has accepted or derived any benefit there from, 

                  such person shall be punishable with fine, if he or his agent of manage, having reason to believe that such riot was likely to be committed or that the unlawful assembly by which such riot was committed was likely to be held, shall not respectively use all lawful means in his or their power to prevent such assembly or riot from taking place, and for suppressing and dispersing the same.

தினம் ஒரு சட்டம் - சட்டவிரோதமான கூட்டத்திற்கு இடத்தின் உரிமையாளர் அனுமதிக்ககூடாது

யாராவது, தம்முடைய இடத்தில் சட்டவிரோதமான கூட்டத்தை அனுமதிக்க கூடாது மேலும் கலகம் நடைப்பெறவும் அனுமதிக்க கூடாது.

அவ்வாறு அவருடைய இடத்தில் அத்தகைய கூட்டம் நடைப் பெற்றால் அதனைப் பற்றி அவர் அருகில் உள்ள காவல் நிலையத்தில் தகவல் அளிக்க வேண்டும்.

அவ்வாறு அந்த இடத்தின் உரிமையாளர் காவல் நிலையத்தில் தகவல் அளிக்காமல் இருப்பது குற்றமாகும் அல்லது அப்படி ஒரு கூட்டத்தின் மூலம் கலகம் நடைப் பெறுவதை அனுமதித்தாலும் குற்றமாகும்.

இந்தக் குற்றத்திற்கு தண்டனையாக அவருக்கு ஆயிரம் ருபாய்க்கு மேற்ப்படாத அபராதம் விதிக்கப்படும்.

இந்தக் குற்றம் இடத்தின் உரிமையாளருக்கு தெரியாமல் அவருடைய வேலையாட்கள் அல்லது மேலாளர் அல்லது பிரதிநிதி செய்ந்தாலும் குற்றமாகும்.

அத்தகைய குற்றம் நடைப்பெறாமல் இருப்பதற்கான அனைத்து நடைவடிக்கைகளையும் அந்த இடத்தின் உரிமையாளர் உடனே எடுத்திருக்க வேண்டும் அப்படி அவர் நடவடிக்கை எடுக்காமல் இருப்பதும் குற்றமாகும்.


Section 154- Owner or occupier of land on which an unlawful assembly is held


           Whenever any unlawful assembly or riot takes place, the owner or occupier of the land upon which such unlawful assembly is held, or such riot is committed, and any person having or claiming an interest in such land, shall be punishable with fine not exceeding one thousand rupees, if he or his agent or manager, knowing that such offence is being or has been committed, or having reason to believe it is likely to be committed, do not give the earliest notice thereof in his or their power to the principal officer at the nearest police-station, and do not, in the case of his or their having reason to believe that it was about to be committed, use all lawful means in his or their power to prevent, it and, in the event of its taking place, do not use all lawful means in his or their power to disperse or suppress the riot or unlawful assembly.

         யாராவது பொது இடத்தில் இருவரோ அல்லது அதற்கு மேற்ப்பட்டவர்களோ சண்டைப் போடுவதும் அல்லது வசைப்பாடுவதும் குற்றமாகும்

Section 159- Affray
     
    When two or more persons, by fighting in a public place, disturb the public peace, they are said to "commit an affray".

யாராவது பொது இடத்தில் இருவரோ அல்லது அதற்கு மேற்ப்பட்டவர்களோ சண்டைப் போடுவதும் அல்லது வசைப்பாடுவதும் செய்ந்தால் அவர்களுக்கு ஒரு மாதக் காலத்துக்குட்பட்ட சிறைக்காவல் அல்லது நூறு ருபாய் வரை அபராதம் தண்டனையாக விதிக்கப்படும்.


Section 160- Punishment for committing affray
      
   Whoever commits an affray, shall be punished with imprisonment of either description for a term which may extend to one month, or with fine which may extend to one hundred rupees, or with both.

தினம் ஒரு சட்டம் - கலகம் உண்டாகும் விதத்தில் பேசினால்

     யாராவது கலகம் உண்டாகும் விதத்தில் பேசி அதனால் கலகம் செய்வதற்கு தூண்டிவிட்டு அதனால் கலகம் ஏற்ப்பட்டால், அந்த கலகத்தை தூண்டியவருக்கு ஒர் ஆண்டு அல்லது ஒர் ஆண்டுகள் மேற்ப்படாத சிறை வாசமும் அல்லது அபராதமும் அல்லது இரண்டும் சேர்த்து தண்டனையாக வழங்கப்படும்.


     அவ்வாறு அவர் தூண்டுதலின் விளைவாகக் கலகம் நடைப் பெறாவிட்டாலும் கலகத்தை தூண்டியவருக்கு ஆறு மாதங்கள் வரை சிறை வாசமும் அல்லது அபராதமும் அல்லது இரண்டும் சேர்த்து தண்டனையாக வழங்கப்படும்.




Section 153- Wantonly giving provocation with intent to cause riot-if rioting be committed-if not committed

         Whoever malignantly, or wantonly, by doing anything which is illegal, gives provocation to any person intending of knowing it to be likely that such provocation will cause the offence of rioting to be committed, shall, if the offence of rioting be committed in consequence of such provocation, 

   be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both ; and if the offence of rioting be not committed, imprisonment of either description for a term which may extend to six months, or with fine, or with both.

     கலகத்தை அடக்க முற்படும்,  பொது ஊழியர்களை அல்லது அரசு அதிகாரிகளை எதிர்ப்போர், தடுப்போர் அல்லது எதிர்த்து வன்முறை சம்பவம் புரிபவர்களுக்கு மூன்று ஆண்டுகளுக்கு மேற்ப்படாத சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக வழங்கப்படும்.


Section 152- Assaulting or obstructing public servant when suppressing riot, etc.
         
     Whoever assaults or threatens to assault, or obstructs or attempts to obstruct, any public servant in the discharge of his duty as such public servant, in endeavouring to disperse an unlawful assembly, or to suppress a riot or affray, or uses, or threatens, or attempts to use criminal force to such public servant, 

     shall be punishable with imprisonment of either description for a term which may extend to three years, or with fine, or with both.

தினம் ஒரு சட்டம் - கலைந்து செல்லாமல் இருக்கும் கூட்டத்திற்கு என்ன தண்டனை

இ.த.ச 151.

         யாராவது, ஒரு பொது ஊழியர் கலைந்து செல்லுமாறு ஆணையிட்டும் அதன் மூலம் ஒரு பொது அமைதிக்கு கேடு உண்டாகும் என்று கருதி கூறிய பின்பும் கலைந்து செல்லாமல் இருக்கும் ஐந்து பேருக்கு மேற்ப்பட்ட கூட்டத்திற்கு ஆறு மாதங்கள் வரை சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக வழங்கப்படும்.

விளக்கம் - அந்த கூட்டம் சட்ட விரோதமாக இ.த.ச பிரிவு 141 ன் படி ஒன்று கூடினால் அவர்களுக்கு இ.த.ச பிரிவு 145 வது பிரிவின் கீழ் தண்டிக்கப்படுவார்கள்.


இ.த.ச 145

        யாராவது சட்டவிரோதமாக கூடி அது சட்ட விரோதமான கூட்டம் எனத் தெரிந்தும் கலைந்துப் போக சொன்னப்பிறகும் கலைந்து போகவில்லை என்றால்,

        அவருக்கு இரண்டு ஆண்டுகள் வரை தண்டனை அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக விதிக்கப்படும்.



Section 151- Knowingly joining or continuing in assembly of five or more persons after it has been commanded to disperse
 
    Whoever knowingly joins or continues in any assembly of five or more persons likely to cause a disturbance of the public peace, after such assembly has been lawfully commanded to disperse, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine, or with both.

Explanation-If the assembly is an unlawful assembly with the meaning of section 141, the offender will be punishable under section 145.

           யாரவது ஒரு சட்ட விரோதமான கூட்டத்திற்கு ஆட்களை வாடகைக்கு அமைத்தாலோ அல்லது அவர்களை அந்த வேலையை பணிக்கும் மாறு அல்லது அந்த வேலையை செய்யுமாறு செய்ந்தாலோ , அந்த சட்ட விரோதமான கூட்டத்தினரால் ஒரு குற்றம் செய்யப்பட்டால் அவர்களை சட்ட விரோதமான கூட்டத்திற்கு வாடகை அமைத்தவர் அல்லது அந்த சட்ட விரோசமான கூட்டத்தின் வேலைலையை செய்யுமாறு அல்லது அந்த சட்ட விரோதமான கூட்டத்தின் வேலையை பணிக்குமாறு கூறியவற்கு அவரும் அந்த சட்ட விரோதமான கூட்டத்தின் பங்கேற்றவராக கருதப்படும் மேலும் அவரும் தண்டனைக்குரியவராவார்.




Section 150- Hiring, or conniving at hiring, of persons to join unlawful assembly
 
     Whoever hires or engages, or employs, or promotes, or connives at the hiring, engagement or employment of any person to join or become a member or any unlawful assembly, shall be punishable as a member of such unlawful assembly, and for any offence which may be committed by any such person as a member of such unlawful assembly in pursuance of such hiring, engagement or employment, in the same manner as if he had been a member of such unlawful assembly, or himself had committed such offence.

தினம் ஒரு சட்டம் - கலகத்தில் பங்குப் பெற்றால் என்ன தண்டனை.


இ.த.ச 149,

      சட்ட விரோதமாக கூடும் கூட்டத்தில் யார் எந்த தவறைச் செய்ந்தாலும் அல்லது குற்றத்தை செய்ந்தாலும் 
    
     அப்போது அந்த கூட்டத்தில் இருந்த ஒவ்வொருவருக்கும் அந்த குற்றத்தில் நேரடியாக பங்கு பெற்றதாக கொள்ளப்படும். அவர்கள் அதற்கேற்ற தண்டனையைப் பெற வேண்டும்.




Section 149- Every member of unlawful 
assembly guilty of offence committed in
 prosecution of common object

If an offence is committed by any member of an unlawful assembly in prosecution of the common object of that assembly, or such as the members or that assembly knew to be likely to be committed in prosecution of that object, every person who, at the time of the committing of that offence, is a member of the same assembly, is guilty of that offence.

Section 146- Rioting
     Whenever force or violence is used by an unlawful assembly, or by any member thereof, in prosecution of the common object of such assembly, every member of such assembly is guilty of the offence of rioting.

         யார் கலகம் செய்ந்தாலும் குற்றமாகும் இந்த குற்றத்தைப் புரிந்த கூட்டத்தில் உள்ள அனைவருக்கும் தலா இரண்டு
        ஆண்டுகளுக்குட்பட்ட சிறைக்காவல் தண்டனை அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக விதிக்கப்படும்.

Section 147- Punishment for rioting
    Whoever is guilty of rioting, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

        யாராவது சட்டவிரோதமாக கூடி அது சட்ட விரோதமான கூட்டம் எனத் தெரிந்தும் கலைந்துப் போக சொன்னப்பிறகும் கலைந்து போகவில்லை என்றால்,

        அவருக்கு இரண்டு ஆண்டுகள் வரை தண்டனை அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக விதிக்கப்படும்.



Section 145- Joining or continuing in unlawful assembly, knowing it has been commanded to disperse
 
      Whoever joins or continues in an unlawful assembly, knowing that such unlawful assembly has been commanded in the manner prescribed by law to disperse,

    யாராவது , பயங்கர ஆயுதத்துடன் அல்லது உயிர் சேதத்தை விளைவிக்க கூடிய ஆயுதங்களுடன் சட்ட விரோதமாக கூடினால் அது குற்றமாகும்.

    இத்தகைய குற்றத்திற்கு அந்த கூட்டத்தில் உள்ள ஒவ்வொருவர் மீதும் சிறைத்காவல் தண்டனை இரண்டு ஆண்டுகள் வரை குறையாத காவல் தண்டனை அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக விதிக்கப்படும்.

யாராவது, தாம் கூடிய கூட்டம் சட்ட விரோதமானது என்று அறிந்தப் பின்னரும் . அந்தக் கூட்டத்தை விட்டு விலகி செல்லாமல் அந்தக் கூட்டத்தில் சேர்ந்திருக்கும் ஒவ்வொரும் சட்ட விரோதமாக கூடிய கூட்டத்தை சேர்ந்தவராகவே கருதப்படும்.

சட்ட விரோதமாக கூடிய கூட்டத்தில் இருப்பவர்களுக்கு ஆறு மாதங்கள் மேற்படாத சிறைக் காவல் அல்லது அபராதம் அல்லது இரண்டும் சேர்த்து தண்டனையாக வழங்கப்படும்



Section 142- Being member of unlawful assembly



    Whoever, being aware of facts which render any assembly an unlawful assembly, intentionally joins that assembly, or continues in it is said to be a member of an unlawful assembly. 

Section 143- Punishment
    Whoever is a member of an unlawful assembly, shall be punished with imprisonment of either description for a term which may extend to six month, or with fine, or with both.

தினம் ஒரு சட்டம் - சட்ட விரோதமாக கூட்டம் கூடுதல்


இ.த.ச 141

      யாராவது ஐந்து அல்லது அதற்கு மேற்ப்பட்டவர்கள் சட்ட விரோத மாக கூடி கீீழ் கானும் செயலை செய்ந்தால் அது சட்ட விரோதமாக கூட்டம் கூடுதல் ஆகும்.

1 - மத்திய அல்லது மாநில அரசை வன் முறைச் செயலாலும் அச்சத்தாலும் தம்தம் கடமையை செய்ய விடாமல் தடுப்பதும்.

2 - சட்டப்படி நிலை நாட்டப்பட்ட ஒரு சட்ட நடவடிக்கையை எதிர்ப்பதும்

3 - அத்துமீறி நுழைதல் அல்லது அத்துமீறி நுழைந்து சொத்துக்களை அழித்தல் அல்லது அது தொடர்பான வேறு குற்றங்களை செய்தல்

4 - அடுத்த மனிதர்களின் தனிப் பட்ட சுதந்திர உரிமைகளில் வன் முறைச் செயலாலும் அல்லது அச்சுறுத்தி அவர்களின் சுதந்திர நடவடிக்கைகளில் ஈடுப்பட்டு அவர்களைத் தடுப்பதும் அல்லது மறுப்பதும் அல்லது பறிப்பதும்.

5 - வன் முறை செயல்கள் மூலம் பிறர் செய்யக்கூடாத காரியத்தை செய்யும் படி பிறரைக் கட்டாயப்படுத்துவதும்.

விளக்கம் - சட்ட விரோதமாக கூட்டம் கூடுதல் எனப்படுவது முதலில் கூட்டம் கூடும் போது சட்ட விரோதமாக இல்லாமல் பிற்பாடு அது சட்ட விரோதமாக கூட்டம் கூடுதலாக ஆகும்.


Section 141- Unlawful assembly
An assembly of five or more persons is designated an "unlawful assembly", if the common object of the persons composing that assembly is-

First-To overawe by criminal force, or show of criminal force, *[the Central or any State Government of Parliament or the Legislature of any State], or any public servant in the exercise of the lawful power of such public servant; or

Second-To resist the execution of any law, or of any legal process; or

Third-To commit any mischief or criminal trespass, or other offence; or

Fourth-By means of criminal force, or show of criminal force, to any person, to take or obtain possession of any property, or to deprive any person of the enjoyment of a right of way, or of the use of water or other incorporeal right of which he is in possession or enjoyment, or to enforce any right or supposed right; or

Fifth-By means of criminal force, or show of criminal force, to compel any person to do what he is not legally bound to do, or to omit to do what he is legally entitled to do.

Explanation-An assembly which was not unlawful when it assembled, may subsequently become an unlawful assembly.

தினம் ஒரு சட்டம் - பொது ஊழியர் குற்றவாளியை தப்பிக்க உதவி செய்ந்தால்

இ.த.ச 130


    யாராவது,  சட்டப்படி சிறைக் காவலில் வைக்கப்பட்டுள்ள ஒரு உள் நாட்டுக் குற்றவாளி அல்லது போர் குற்றவாளியை  தப்ப வைக்க உதவி செய்தல் அல்லது மீட்டல் அல்லது தப்பி வந்த கைதிக்கு அடைக்கலம் கொடுத்தல் அல்லது தப்பிய ஒடிய குற்றவாளியை கைது செய்ய வரும் போது தடுத்தல் அல்லது தடுப்பதற்கு முயற்சி செய்தல் போன்ற எந்த குற்றத்தை செய்ந்தாலும் குற்றமாகும்.


இத்தகைய குற்றத்திற்கு ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரை குறையாத சிறைக்காவல் தண்டனை அத்துடன் அபராதமும் விதிக்கப்படும்.


Section 130- Aiding escape of, rescuing or harbouring such prisoner

   Whoever knowingly aids or assists any State prisoner or prisoner of war in escaping from lawful custody, or rescues or attempts to rescue any such prisoner, or harbours or conceals any such prisoner who has escaped from lawful custody, or offers or attempts to offer any resistance to the recapture of such prisoner, 

   shall be punished with *[imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

Explanation-A State prisoner or prisoner of war, who is permitted to be at large on his parole within certain limits in **[India], is said to escape from lawful custody if he goes beyond the limits within which he is allowed to be at large.

    யாராவது, ஒரு பொது ஊழியர் தம் வசத்தில் சிறைக் காவலில் வைக்கப்பட்டுள்ள ஒரு உள் நாட்டுக் குற்றவாளி அல்லது போர் குற்றவாளியை கவனக் குறைவால் தப்ப விட்டால் குற்றமாகும்.

   இந்தக் குற்றத்திற்கு முன்று ஆண்டுகள்  வரை குறையாத வெறும் காவல் தண்டனை அத்துடன் அபராதமும் விதிக்கப்படும்.




Section 129- Public servant negligently suffering such prisoner to escape
    Whoever, being a public servant and having the custody of any State prisoner or prisoner of war, negligently suffers such prisoner to escape from any place of confinement in which such prisoner is confined, 

    shall be punished with simple imprisonment for a term which may extend to three years, and shall also be liable to fine.

தினம் ஒரு சட்டம் - பொது ஊழியர் குற்றவாளியை தப்ப விட்டால்



இ.த.ச 128

    யாராவது, ஒரு பொது ஊழியர் தம் வசத்தில் சிறைக் காவலில் வைக்கப்பட்டுள்ள ஒரு உள் நாட்டுக் குற்றவாளி அல்லது போர் குற்றவாளியை மனம் முன் வந்து தப்ப விட்டால் குற்றமாகும்.

   இந்தக் குற்றத்திற்கு ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரை குறையாத சிறைக்காவல் தண்டனை அத்துடன் அபராதமும் விதிக்கப்படும்.


Section 128- Public servant voluntary allowing prisoner of State or war to escape
 

    Whoever, being a public servant and having the custody of any State prisoner or prisoner of war, voluntarily allows such prisoner to escape from any place in which such prisoner is confined,

     shall be punished with *[imprisonment for life], or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

     யாராவது இ.தச பிரிவு - 125 ன் படி நட்பு நாட்டிற்கு எதிராக போர் தொடுக்க அல்லது  இ.தச பிரிவு - 126 ன் படி நட்பு நாட்டிற்கு எதிராகவும் இழிவாகவும் பேச எவ்விதமான சன்மானத்தைப் பெற்றாலும் குற்றமாகும். 

இந்தக் குற்றத்திற்கு ஏழு ஆண்டுகளுக்கு வரை சிறைக்காவலுடன் அபராதமும்  தண்டனையாக விதிக்கப்படும். அத்துடன் அவருக்கு கிடைத்த சன்மானமும் பறிமுதல் செய்யப்படும்.


 


Section 127- Receiving Property taken by war on depredation mention in Sections 125 and 126
 
     Whoever receives any property knowing the same to have been taken in the in the commission of any of the offences mentioned in Sections 125 and 126, 


     shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine and to forfeiture of the property so received.

தினம் ஒரு சட்டம் - நட்பு நாட்டிற்கு எதிராகவும் இழிவாகவும் பேசினால்

     யாராவது, இந்திய தேசத்தின் நட்புறவு ஆசிய நாட்டுகளுக்கு எதிராக பேசுவதும்அல்லது இழிவாக பிரச்சாரம் செய்வதும் அல்லது அத்தகைய குற்றத்திற்கு உடந்தையாக இருப்பது போன்றவை குற்றமாகும்.




   இந்தக் குற்றத்திற்கு ஆயுள் தண்டனை அல்லது ஏழு ஆண்டுகளுக்கு வரை சிறைக்காவலுடன் அபராதமும் அல்லது அபராதம் மட்டும் விதிக்கப்படும்.




Section 126- Committing depredation on territories of Power at peace with the Government of India

     Whoever commits depredation, or makes preparation to commit depredation, on the territories of any Power in alliance or at peace with the *[Government of India], 

     shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine and to forfeiture of any property used or intended to be used in committing such depredation, or acquired by such depredation.
