தினம் ஓரு சட்டம் - இ.த.ச 205 - பொய்ச்சான்று தண்டனைகள்-11



ஒரு வழக்கில் அல்லது குற்ற நடவடிக்கையில் ஆள் மாறாட்டம் செய்வது தவறாகும். ஒருவருக்கு பதிலாக மற்றோருவர் தாம் அவர்தான் என்று வந்து நிற்பதும் ஆள்மாறாட்டமாகும். அத்தகைய ஆள் மாறாட்டம் செய்வதும் மூலம் ஒப்புதல் வாக்குமுலம் தருவதும், தீர்ப்பினை ஏற்றுக்கொள்வதும், ஆணை பிறப்பிக்கும்படி செய்வதும், பினையாக நிற்பதும் அல்லது அத்தகைய வேறு எந்த வேலைகளையாவது ஒரு வழக்கில் அல்லது ஒரு குற்ற நடவடிக்கையில் செய்வது குற்றமாகும்.

இந்தக் குற்றத்திற்கு மூன்று ஆண்டுகள் வரை சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும்.



IPC 205- False personation for purpose of act or proceeding in suit



Whoever falsely personates another, and in such assumed character makes any admission or statement, or confesses judgment, or causes any process to be issued or becomes bail or security, or does any other act in any suit or criminal prosecution, 


shall be punished with imprisonment of either description for a term which may extend to three years or with fine, or with both.

சபதம் ஏற்போம் - பயனுள்ள புத்தகத்தை தினமும் ஒரு மணி நேரம் படியுங்கள்: அப்துல் கலாம்




விடைப்பெறுகிறேன் இளைஞர்களே....

 அரியலூர் அரசு மேல்நிலைப் பள்ளி மைதானத்தில் வெள்ளிக்கிழமை மாலை புத்தகத் திருவிழாவை தொடக்கி வைத்து, அவர் மேலும் பேசியது:


 நல்ல புத்தகங்கள் கற்பனைத் திறனை வளர்க்கும். இதனால் படைப்பாற்றல் வளரும். 

படைப்பாற்றலால் சிந்திக்கும் திறன் பெருகும். சிந்திக்கும் திறன் அறிவை வளர்க்கும். அறிவு மனிதனை மகானாக்கும். அதுதான் புத்தகம்.
 

இந்தப் புத்தகத் திருவிழா அறிவுக் கண்ணை, மனக்கண்ணை திறக்கும் விழா. இதில் கலந்துகொள்வதில் எனக்கு பெருமகிழ்ச்சி. 

"நற்புத்தகங்கள் எனது அரும்பெரும் ஆசான்' என்ற தலைப்பில் உங்களுடன் கலந்துரையாட வந்திருக்கிறேன்.


 நாம் எவ்வளவு புத்தகங்கள் படித்தோம் என்பது முக்கியமல்ல. அதில் எத்தனை புத்தகங்களை உள்வாங்கி படித்தோம் என்பதுதான் முக்கியம். பேச்சு வழக்கில் இருந்த தமிழை காகிதமாக்கி வழங்கியதில் முன்னோர்களின் பங்கு அளப்பரியது. 


 அதில் திருவள்ளுவர், அனைவராலும் பின்பற்றக்கூடிய திருக்குறளை உலகுக்கு தந்தவர், தமிழ்த்தாத்தா உ.வே. சாமிநாதய்யர் ஓலைச்சவடிகளை பாதுகாத்து தந்தவர், ஜி.யு. போப் மதம் கடந்து, நாடு கடந்து, மொழி கடந்து தமிழுக்கு தொண்டாற்றியவர், பாரதியார் 100 ஆண்டுகளுக்கு முன்பே இந்திய நதிகளை இணைக்க வேண்டும் என்று குரல் கொடுத்தவர்.

 புத்தகங்கள் படியுங்கள், படித்துக்கொண்டே இருங்கள். இன்று முதல் மாணவர்களாகிய நீங்கள், இளைஞர்களாகிய நீங்கள் ஒரு சபதம் எடுத்துக் கொள்ள வேண்டும்; தினமும் 1 மணி நேரம் பயனுள்ள புத்தகத்தை படிக்க நேரம் ஒதுக்குவேன் என்று. அதனால், புத்தகங்கள் உங்களுக்கு நண்பனாகும். ஒவ்வொரு வீட்டிலும் சிறிய நூலகம் ஏற்படுத்த வேண்டும் என்றார் அப்துல் கலாம்.


 விழாவில் அரியலூர் மாவட்ட அளவில் எஸ்.எஸ்.எல்.சி தேர்வில் தேர்ச்சி பெற்ற மாணவ, மாணவிகளுக்கு அப்துல்கலாம் பரிசுகள் வழங்கிப் பாராட்டினார்.

தினம் ஓரு சட்டம் - இ.த.ச 204 - பொய்ச்சான்று தண்டனைகள்-10



    நீதிமன்றத்திற்குச் சாட்சியமாகக் கொண்டு வரத்தக்க ஆவணத்தை அழித்தும், மாற்றியும் அல்லது உருக்குலைத்தும் அதனைச் சாட்சியமாக நீதிமன்றத்தில் பயன்படுத்த விடாமல் செய்வது குற்றமாகும். அத்தகைய ஆவணத்தை ஒரு அரசு பொது அதிகாரியின் முன் கொண்டு வருவதைத் தடுக்கும் வகையில் இடர்கள் செய்வது குற்றமாகும்.



 ஒரு நீதிமன்றம் அல்லது ஒரு அரசு பொது அதிகாரி அத்தகைய ஆவணத்தைத் தம் முன்னர் சமர்ப்பிக்குமாறு ஆணையிட்ட பின்னர் அதனைச் சிதைப்பதும் அல்லது அழிப்பதும் குற்றமாகும். 


இத்தகைய குற்றத்திற்கு இரண்டு ஆண்டுகள் வரைச் சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக வழங்கப்படும்.

Section 204- Destruction of document or 
electronic record to prevent its production as 
sevidence




Whoever secretes or destroys any *[document or Electronic Record] which he may be lawfully compelled to produce as evidence in a Court of Justice, or in any proceeding lawfully held before a public servant as such, or obligates or renders illegible the whole or any part of such 1[document or Electronic Record] with the intention of prevention the same from being produced or used as evidence before such Court or public servant as aforesaid, or after he shall have been lawfully summoned or required to produce the same for that purpose, 

shall be punishable with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

நடைப்பெற்ற ஒருக் குற்றத்தைப்பற்றி வேண்டும் என்றே திரித்து பொய்யான தகவலைக் கொடுப்பவருக்கு இரண்டு ஆண்டுகள் வரைச் சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக வழங்கப்படும்.




விளக்கம் - இக் குற்றங்கள் இந்தியாவுக்கு வெளியே நடைப்பெற்றாலும், 302, 304, 382, 392, 393, 394, 395, 396, 397 398, 399, 402, 435, 436, 449, 450, 457, 458, 459 மற்றும் 460 ஆகிய பிரிவுகளின் கீழ் தண்டிக்கத்தக்க எத்தகைய குற்றமானாலும் இ.த.ச பிரிவு 201, 201 மற்றும் 203 ஆகிய பிரிவுகளில் அடங்கும்.





IPC 203 : Giving false information respecting an offence committed.

Whoever knowing or having reason to believe that an offence has been committed, gives any information respecting that offence which he knows or believes to be false, shall be punished with imprisonment of either description for a term which may extend to two year, or with fine, or with both.

*[Explanation: - In sections 201 and 202 and in this section the word "offence" includes any act committed at any place out of *[India], which, if committed in *[India], would be punishable under any of the following sections, namely, 302, 304, 382, 392, 393, 394, 395, 396, 397 398, 399, 402, 435, 436, 449, 450, 457, 458, 459 and 460.]

இ.த.ச 202 - பொய்ச்சான்று தண்டனைகள்-8




    ஒர் குற்றம் நடைப்பெற்றிருப்பதை அறிந்தப் பின்னரும் அதைப்பற்றிய தகவலை வேண்டும் என்றே சம்பந்தப்பட்டவருக்கு தெரிவிக்காமல் இருப்பதும் தண்டிக்கத்தக்க குற்றமாகும். 

இந்தக் குற்றத்திற்கு ஆறு மாதங்கள் வரை சிறைக்காவல் அல்லது அபராதம்  அல்லது இரண்டும் தண்டனையாக வழங்கப்படும்.







Section 202- Intentional omission to give information of offence by person bound to informinformation of offence by person bound to inform

   
Whoever, knowing or having reason to believe that an offence has been committed, intentionally omits to give any information respecting that offence which he is legally bound to give, 

    shall be punished with imprisonment of either description for a term which may extend to six months, or with fine, or with both.

இ.த.ச 201 - பொய்ச்சான்று தண்டனைகள்-7

ஒரு குற்றம் நடைப்பெற்றதை நாம் அறிகிறோம். அல்லது அதனைப்பற்றி அறியும் வாய்ப்பு நமக்கு இருக்கிறது. அந்த நிலையில் அந்தக்குற்றம் பற்றிய சாட்சியத்தை, குற்றவாளியைக் காப்பற்ற வேண்டும் என்ற தீய நோக்கத்துடன் மறைப்பது குற்றமாகும். அந்த நோக்கத்துடன் நடைப்பெற்ற குற்றத்தைப் பற்றிய பொய்யான தகவலைப் தருவதும் தண்டனைக்குரிய குற்றமாகும்.


அப்படி மரணத்தண்டனை விதிக்கத்தக்க குற்றம் நடைப்பெற்றிருந்தால் , அப்படிச் செய்தவருக்கு ஏழு ஆண்டுகள் வரை சிறைக்காவலுடன் அபராதமும் தண்டனையாக வழங்கப்படும்.

ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரைச் சிறைக்காவல் விதிக்கத்தக்க குற்றம் நடைப்பெற்றிருந்தால், மூன்று ஆண்டுகள் வரை சிறைக்காவலுடன் அபராதமும் தண்டனையாக வழங்கப்படும்.

பத்து ஆண்டுகளுக்கும் குறைவான தண்டனை பெறத்தக்க குற்றம் நடைப்பெற்றிருந்தால், அந்த குற்றத்திற்கு விதிக்கத்தக்க தண்டனையில் நான்கில் ஒரு பாகத்தை சிறைக்காவலாகவும் அல்லது அபராதமாகவும் அல்லது இரண்டும் தண்டனையாக வழங்கப்படும்.










Section 201- Causing disappearance of evidence of offence, or giving false information to screen offender 
Whoever, knowing or having reason to believe that an offence has been committed, causes any evidence of the commission of that offence to disappear, with the intention of screening the offender from legal punishment, or with that intention gives any information respecting the offence which he knows or believes to be false,

If a capital offence.- shall, if the offence which he knows or believes to have been committed is punishable with death, be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine;

If punishable with imprisonment for life.- and if the offence is punishable with *[imprisonment for life], or with imprisonment which may extend to ten years, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine;

If punishable with less than ten years' imprisonment.- And if the offence is punishable with imprisonment for any term not extending to ten years, shall be punished with imprisonment of the description provided fro the offence, for a term which may extend to one-fourth part of the longest term of the imprisonment provided for the offence, or with fine, or with both.

Illustration

A, knowing that B has murdered Z, assists B to hide the body with the intention of screening B from punishment. A is liable to imprisonment of either description for seven years, and also to fine.

யாராவது, தாம் அளித்துள்ள அல்லது ஒப்புதல் கொடுத்துள்ள அறிக்கையில் காணப்படும் விவரங்களை ஒரு நிதிமன்றம் அல்லது பொது ஊழியர் அல்லது சட்டத்தின் கீழ் பணியாற்றுகின்ற அதிகாரம் பெற்றுள்ள வேறு யாராவது சாட்சியமாக பயன்படுத்துவார்கள் என்று தெரிந்தும், அந்த அறிக்கையில் அதன் நோக்கத்தைப் பாதிக்கக்கூடிய வகையில் பொய்யான அல்லது உண்மைக்கு மாறான விவரங்களைத் தருவதும் அல்லது உபயோகப்படுத்துவதும் குற்றமாகும்.  பொய்சாட்சி சொன்னவர்களுக்கு அல்லது உருவாக்கியவர்களுக்கு அளிப்படவேண்டிய தண்டனையே விதிக்கப்படவேண்டும்.



Section 199:- False statement made in declaration which is by law receivable as evidence


Whoever, in any declaration made or subscribed by him, which declaration any Court of Justice, or any public servant or other person, is bound or authorized by law to receive as evidence of any fact, makes any statement which is false, and which he either knows or believes to be false or does not believe to be true, touching any point material to the object for which the declaration is made or used, shall be punished in the same manner as if he gave false evidence. 



 இ.த.ச 200 - பொய்ச்சான்று தண்டனைகள்-7

  இ.த.ச 199 க்கூறப்பட்டுள்ள படி ஒர் அறிக்கை அல்லது நிகழ்வு பொய்யானது என்று தெரிந்திருந்தும் , அதனை உண்மையானதுப் போல பயன்படுத்துவோருக்கும் பயன்படுத்த முயற்சி செய்வோருக்கும் பொய்ச் சாட்சியம் கூறியவருக்குரிய தண்டனை கிடைக்கும்.

விளக்கம் - அத்தகைய அறிக்கை ஒழங்கற்றது என்று கருதி நீதிமன்றம் தள்ளக்கூடியதாக இருப்பினும், அதனை இ.த.ச 199 மற்றும்  இ.த.ச 200 ஆகியப்பிரிவுகளில் விளக்கப்பட்ட அறிக்கை என்று எடுத்துக் கொள்ள வேண்டும்.






 IPC 200 Using as true such declaration knowing it to be false

Whoever corruptly uses or attempts to use as true any such declaration, knowing the same to be false in any material point, shall be punished in the same manner as if he gave false evidence.

IPC 196. Using evidence known to be false

Whoever corruptly uses or attempts to use as true or genuine evidence any evidence which he knows to be false or fabricated, shall be punished in the same manner as if he gave or fabricated false evidence.



இ.த.ச 197 - பொய்ச்சான்று தண்டனைகள்-4

அதிகாரப்பூர்வமாகப் பயன்படுத்தக்கூடிய அத்தாட்சிப் பத்திரத்தில், பொய்யான தகவல்களை உண்மையேன்று பதிவோருக்கும், அதனைச் சாட்சியாமாகப் பயன்படுத்துவோருக்கும் பொய்சாட்சி சொன்னவர்களுக்கு அல்லது உருவாக்கியவர்களுக்கு அளிப்படவேண்டிய தண்டனையே விதிக்கப்படவேண்டும்.

IPC 197 . Issuing or signing false certificate

 Whoever issues or signs any certificate required by law to be given or signed, or relating to any fact of which such certificate is by law admissible in evidence, knowing or believing that such certificate is false in any material point, shall be punished in the same manner as if he gave false evidence.




இ.த.ச 198 - பொய்ச்சான்று தண்டனைகள்-5


 அதிகாரப்பூர்வமாகப் பயன்படுத்தக்கூடிய அத்தாட்சிப் பத்திரத்தில், பொய்யான தகவல்களை உண்மையேன்று அளித்து அது பொய்யானது என்று அறிந்தப்பின்னர் அதனை உண்மையானது என்று பயன்படுத்துவோருக்கும் பயன்படுத்த முயற்சி செய்பவருக்கும், பொய்சாட்சி சொன்னவர்களுக்கு அல்லது உருவாக்கியவர்களுக்கு அளிப்படவேண்டிய தண்டனையே விதிக்கப்படவேண்டும்.


198S. Using as true a certificate known to be false


 Whoever corruptly uses or attempts to use any such certificate as a true certificate, knowing the same to be false in any material point, shall be punished in the same manner as if he gave false evidence.

தம்முடைய சாட்சியத்தியத்தின் மூலம் ஒருவருக்கு ஆயுள் தண்டனை அல்லது ஏழு ஆண்டுகளுக்கு மேற்ப்பட்ட சிறைக்காவல் தண்டனையாக விதிக்கப்படும் என்று தெரிந்தப்பின்னரும், ஒருவர் பொய் சாட்சி உருவாக்கினாலும் , அந்த நபருக்கு, அந்த நபர் எத்தகைய குற்றத்தைப்பற்றிச் சாட்சியம் அளித்தாரோ அத்தகைய குற்றத்திற்கு உரிய தண்டனையை விதிக்கப்படவேண்டும்.

இ.த.ச 194 - மரணத் தண்டனை வழங்க கூடிய குற்றத்துக்குரிய பொய்ச்சான்றுக்கான தண்டனைகள்

     யாராவது ஒருவர், தாம் அளிக்கின்ற சாட்சியத்தின் மூலம் மற்றோருவர் மீது மரணத்தண்டனை விதிக்கத்த குற்றச்சாட்டு சுமத்தப்படும் என்று தெரிந்தும், பொய்ச்சான்று தந்தாலும், அல்லது பொய்ச்சான்றினை உருவாக்கினாலும் குற்றமாகும்.

  அந்த நபருக்கு ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரை கடுங்காவலுடன் கூடிய தண்டனை விதிக்கப்படும்.

   அத்தகைய சாட்சியத்தின் விளையாக ஒரு நிரபராதி குற்றம் சாட்டித் தண்டிக்கப்பட்டு, தண்டனையும் நிறைவேறப்பட்டால், அத்தகைய சாட்சியத்தைத் தந்தவருக்கு மரணத்தண்டனை அல்லது ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரை கடுங்காவலுடன் கூடிய தண்டனை விதிக்கப்படும்.




 IPC 194 : Giving or fabricating false evidence with intent to procure conviction of capital offence.

Whoever gives or fabricates false evidence, intending thereby to cause, or knowing it to be likely that he will thereby cause, any person to be convicted of an offence which is capital by the laws for the time being in force in India shall be punished with imprisonment for life, or with rigorous imprisonment for a term which may extend to ten years, and shall also be liable to fine;

If innocent person be thereby convicted and executed — and if an innocent person be convicted and executed in consequence of such false evidence, the person who gives such false evidence shall be punished either with death or the punishment hereinbefore described.



குறிப்பு - இந்த பகுதியில் உள்ளவற்றை பொது அறிவாக மட்டும் எடுத்துக் கொள்ள வேண்டும் ஏதாவது சட்ட நுனுக்கம் தவறாக இருப்பின் சுட்டிக் காட்டுங்கள் திருத்திக்கொள்கிறோம்.  இதையே இறுதி வடிவமாக எடுத்துக் கொள்ளக்கூடாது. மேலும் இது வழக்குக்குரியதல்ல.

      யாராவது ஒருவர், நீதிமன்றத்தின் முன் கருத்துடன் பொய்ச்சான்று அளிப்பவருக்கும், நீதிமன்றத்தில் பயன்படுத்துவதற்குப் பொய்ச் சான்றினை உருவாக்குவோருக்கும் ஏழு ஆண்டுகள் வரை சிறைக் காவலுடன் அபராதமும் தண்டனையாக விதிக்கப்படும்.

    வேறு எவ்விதமான வகைகளில் பொய்ச் சான்று உருவாக்குபவர்களுக்கு மூன்று ஆண்டுகள் வரை சிறைக்காவலுடன் அபராதமும் தண்டனையாக விதிக்கப்படும்.

     ஒர் சட்டப்படி அமைக்கப்பட்ட படை நீதி மன்றத்தில் நடைப்பெறும் விசாரனையை நீதிமன்ற விசாரனையாகவே கொள்ள வேண்டும்.

விளக்கம் 2-

     ஒர் நீதிமன்றத்தில் விசாரணை நடத்துவதற்கு முன்னதாகச் சட்டபூர்வமாக உத்தரவிடப்பட்ட ஆய்வினை நீதிமன்ற விசாரணையின் ஒரு பகுதியாகக் கருதவேண்டும்.  அத்தகைய ஆய்வு ஒரு நீதிமன்றத்தில் நடைப்பெறவில்லையென்றாலும் கருத்தில் கொள்ளவேண்டும். அது ஒரு திருப்பாயத்தில் நடைப்பெற்றாலும்.



விளக்கம் 3-




  ஒர் நீதிமன்றத்தின் உத்திரவும் அங்கீகாரமும் பெற்று நடைப்பெறும் விசாரனையை, நீதிமன்ற விசாரனையின் ஒரு அங்கமாகவே கருதப்படவேண்டும் அல்லது ஏற்றுக் கொள்ளப்பட வேண்டும்.





Section 193. Punishment for false evidence

 

    Whoever intentionally gives false evidence in any stage of a judicial proceeding, or fabricates false evidence for the purpose of being used in any stage of a judicial proceeding, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine,
and whoever intentionally gives or fabricates false evidence in any other case, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

 

Explanation 1
A trial before a Court-martial; 1[* * *] is a judicial proceeding.

 

Explanation 2
     An investigation directed by law preliminary to a proceeding before a Court of Justice, is a stage of a judicial proceeding, though that investigation may not take place before a Court of Justice.

 

Illustration
A, in an enquiry before a Magistrate for the purpose of ascertaining whether Z ought to be committed for trial, makes on oath a statement which he knows to be false. A this enquiry is a stage of a judicial proceeding, A has given false evidence.

 

Explanation 3
An investigation directed by a Court of Justice, according to law, and conducted under the authority of a Court of Justice, is a stage of a judicial proceeding, though that investigation may not take place before a Court of Justice.


Illustration

 

     A, in any enquiry before an officer deputed by a Court of Justice to ascertain on the spot the boundaries of land, makes on oath a statement which he knows to be false. As this enquiry is a stage of a judicial proceeding. A has given false evidence.

PLS TELL ME WHAT WHY 7 OR 3 YEARS CLASSIFICATION IS MADE IN 193 IPC.

Yes it can be upto 7 years or 3 years depending upon what statement he has given u/s 164CrPC.

இ.த.ச 192 - பொய்ச்சான்றினை உருவாக்குதல்



           ஒரு நீதிமன்றத்தில் சாட்சியமாகத் தாக்கல் செய்யப்பட இருக்கும் ஒரு புத்தகத்தில் அல்லது ஆவணத்தில் ஒரு பொய்யான தகவலைப் பதிவு செய்யவைப்பதும், ஒரு தவறானப் பதிவு செய்யவைப்பதும், ஒரு தவறான சூழ்நிலையை உண்மையானதாக்த் தோன்றும்படி உருவாக்குவதும் குற்றமாகும். ஏனேன்றால் அந்தத் தவறான தகவலை நம்பி ஒரு பொது ஊழியரோ அல்லது ஒரு நீதிமன்றமோ உண்மைக்கு புறம்பான ஒரு கருத்தினை உருவாக்க நேரிடும். ஆகவே இந்தக் குற்றத்தை பொய்ச் சான்றினை உருவாக்குதல் என்று கூறுகிறோம்.

Whoever causes any circumstance to exist or 1[makes any false entry in any book or record or Electronic Record, or makes any document or Electronic Rercord containing a false statement], intending that such circumstance, false entry or false statement may appear in evidence in a judicial proceeding, or in a proceeding taken by law before a public servant as such, or before an arbitrator, and that such circumstance, false entry or false statement, so appearing in evidence, may cause any person who in such proceeding is to form an opinion upon the evidence, to entertain an erroneous opinion touching any point material to the result of such proceeding, is said "to fabricate false evidence".

Illustrations

(a) A puts jewels into a box belonging to Z, with the intention that they may be found in that box, and that this circumstance may cause Z to be convicted of theft. A has fabricated false evidence.

(b) A makes a false entry in his shop-book for the purpose of using it as corroborative evidence in a Court of Justice. A has fabricated false evidence.

இ.த.ச 191

சத்தியப்பிரமாணம் செய்து உண்மையை கூறுவதாக சத்தியம் செய்து சான்று அளிக்கும்போது போது உண்மையைத்தான் கூறவேண்டும். உண்மைக்கு புறம்பானவற்றை உண்மையென்று கூறுவதைப் பொய்ச் சான்று அளித்தல் என்கிறோம்.




விளக்கம்-1.
வாய்மொழியாகக் கொடுக்கும் வாக்குமுலத்தையன்றி எழத்து முலமாகத் தரப்படும் வாக்குமூலங்களும் இதில் அடங்கும்.


விளக்கம்-2.
தனக்குத் தெரிந்தவற்றைத் தெரியாது என்பதும், தெரியாததைத் தெரியும் என்று கூறுவதும் பொய்ச்சான்று ஆகும்.


Section 191 in The Indian Penal Code
191. Giving false evidence.—Whoever, being legally bound by an oath or by an express provision of law to state the truth, or being bound by law to make a declaration upon any subject, makes any statement which is false, and which he either knows or be­lieves to be false or does not believe to be true, is said to give false evidence. 
Explanation 1.—A statement is within the meaning of this sec­tion, whether it is made verbally or otherwise. 
Explanation 2.—A false statement as to the belief of the person attesting is within the meaning of this section, and a person may be guilty of giving false evidence by stating that he believes a thing which he does not believe, as well as by stating that he knows a thing which he does not know. 
Illustrations 

(a) A, in support of a just claim which B has against Z for one thousand rupees, falsely swears on a trial that he heard Z admit the justice of B’s claim. A has given false evidence. 

(b) A, being bound by an oath to state the truth, states that he believes a certain signature to be the handwriting of Z, when he does not believe it to be the handwriting of Z. Here A states that which he knows to be false, and therefore gives false evidence. 

(c) A, knowing the general character of Z’s handwriting, states that he believes a certain signature to be the handwriting of Z; A in good faith believing it to be so. Here A’s statement is merely as to his belief, and is true as to his belief, and there­fore, although the signature may not be the handwriting of Z, A has not given false evidence. 

(d) A, being bound by an oath to state the truth, states that he knows that Z was at a particular place on a particular day, not knowing anything upon the subject. A gives false evidence whether Z was at that place on the day named or not. 

(e) A, an interpreter or translator, gives or certifies as a true interpretation or translation of a statement or document which he is bound by oath to interpret or translate truly, that which is not and which he does not believe to be a true interpretation or translation. A has given false evidence.
