தினம் ஒரு சட்டம் - இ.த.ச 403 - பிறர் சொத்துக்களை கையாடல்

    யாராவது ஒருவர், நேர்மையின்றி அநியாயமாக ஒர் அசையும் பொருளைத் தன்னுடைய சொந்த உபயோகத்திற்காக உரிமையாளரின் சம்மதமின்றி மாற்றிக் கொள்வது சொத்தை கையாடல் செய்ந்த குற்றமாகும்

    இந்தக் குற்றத்திற்கு இரண்டு ஆண்டுகள் வரை சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும். 

உதாரணம் 1-

   செந்திலுக்கு சொந்தமான சொத்தைத் தன்னுடையது என்று நம்பி ராஜேஸ்வரி , நல்லெண்ணத்துடன் அதனை எடுத்துக்கொள்கிறாள். இந்த நிலையில் ராஜேஸ்வரி மீது திருட்டுக் குற்றம் சாட்ட முடியாது. ஆனால் தன்னுடைய தவறைத் உணர்ந்த பிறகும் ராஜேஸ்வரி, நேர்மையின்றி அந்தச் சொத்தைத் தன் சொந்த உபயோகத்திற்கென வைத்துக் கொண்டால், ராஜேஸ்வரி மீது இந்தப் பிரிவின் கீழ்க் குற்றம் சாட்டப்படும்.



உதாரணம் 2-

 செந்திலும் சந்தோஷூம் நண்பர்கள், செந்தில் வீட்டிற்கு சென்ற சந்தோஷ் அவருடைய அனுமதியின்றி அவருடைய புத்தகத்தை எடுத்து வந்து விடுகிறார் . அவர் நண்பர் எதுவும் தப்பாக எடுத்துக் கொள்ள மாட்டார் என ஆனால் திருப்பி தர வேண்டும். இது இப்பிரிவின் கீழ் குற்றமாகாது. ஆனால் அந்த புத்தகத்தை செந்திலுக்கு தெரியாமல் விற்று காசாக்குவது அந்தக் காசை எடுத்துக் கொள்ளவது, சந்தோஷ் மீது கையாடல் செய்ந்த குற்றம் சுமத்தப்படும்.

உதாரணம் 3-

செந்திலும் வளவனும் ஒரு குதிரையின் பங்காளர்கள் - இருவரும் சேர்ந்து ஒரு குதிரையை வாங்கியுள்ளார்கள். ஆனால் செந்திலினிடமிருந்து வளவன் தன் சொந்த உபயோகத்திற்காக அழைத்து செல்கிறான், அவ்வாறு அனுமதியுடன் அழைத்து செல்வது குற்றமாகாது, ஆனால் வளவன் அந்தக் குதிரையை விற்று அந்த பணம் முழுவதையும் எடுத்துக் கொள்வது இந்தப் பிரிவின் கீழ் குற்றமாகும்.  

விளக்கம் - 1

ஒரு தடவை நேர்மையின்றி கையாடல் செய்ந்தாலும் இந்தப் பிரிவின் கீழ் குற்றமாகும். 

Section 403- Dishonest misappropriation of property




  Whoever dishonestly misappropriates or converts to his own use any movable property, 


    
 shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

Illustrations

(a) A takes property belonging to Z out of Z's possession, in good faith, believing, at any time when he takes it, that the property belongs to himself. A is not guilty of theft; but if A, after discovering his mistake, dishonestly appropriates the property to his own use, he is guilty of an offence under this section.

(b) A, being on friendly term with Z, goes into Z's library in Z's absence, and takes away a book without Z's express consent. Here, if A was under the impression that he had Z's implied consent to take the book for the purpose of reading it, A has not committed theft. But, if A afterwards sells the book for his own benefit, he is guilty of an offence under this section.

(c) A and B, being joint owners of a horse, A takes the horse out of B's possession, intending to use it. Here, as A has a right to use the horse, he dose not dishonestly misappropriate it. But, if A sells the horse and appropriates the whole proceeds to his own use, he is guilty of any offence under this section.

Explanation.1-A dishonest misappropriation for a time only is a misappropriation with the meaning of this section.

Illustration

A finds a government promissory note belonging to Z, bearing a blank endorsement. A knowing that the note belongs to Z, pledges it with a banker as a security for a loan, intending at a future time to restore it to Z. A has committed an offence under this section.

Explanation 2. -A person who finds property not in the possession of any other person, and takes such property for the purpose of protecting if for, or of restoring it to, the owner does not take or misappropriate it dishonestly, and is not guilty of an offence; but he is guilty of the offence above defined, if the appropriates it to his own use, when the knows or has the means of discovering the owner, or before he has used reasonable means to discover and give notice to the owner and has kept the property a reasonable time to enable the owner to claim it.

What are reasonable means or what is a reasonable time in such a case, is a question of fact.

It is not necessary that the finder should know who is the owner of the property, or that any particular person is the owner of it; it is at the time of appropriating it, he does not believe it to be his own property, or in good faith believe that the real owner cannot found.

Illustrations

(a) A find a rupee on the high road, not knowing to whom the rupee belongs, A picks up the rupee. Here A has not committed the offence defined in this section.

(b) A finds a letter on the road, containing a bank 


Exchanging a railway ticket


     A and В were about to board a train from Benares City. A had a valid ticket to Ajudhia while В had a valid ticket to Benares Cantonment. A voluntarily gave her ticket to В to check as to whether her ticket for the journey was valid. While returning A’s ticket back to her В deliberately substituted his ticket in its place and gave the same to her while keeping her ticket with him. В was held guilty of criminal misappropriation of property and not of cheating.

Harvesting crops under attachment


     Where the accused judgment debtor, whose standing crops had been attached, harvested the same while the order of attachment was in force, it was held that he had committed an offence under this section.
The offence under section 403 is non-cognizable, bailable and compoundable when permitted by the court which is trying the case, and is triable by any magistrate.
