தினம் ஒரு சட்டம் - திருமணம் தொடர்பான குற்றங்களும் அதன் தண்டனைகளும்-2

யாராவது,  இ.த.ச பிரிவு 494 வது பிரிவின் கீழ் தண்டனைக்குரிய குற்றத்தைப் புரிகின்ற நபர், மீண்டும் திருமணம் செய்யும் போது, தனக்கு ஏற்கனவே திருமணம் ஆகியுள்ளது என்பதைப் பற்றிய விவரத்தை, தன்னை திருமணம் செய்ந்துக் கொள்ளும் நபருக்கு கூறாமல் மறைத்து வைத்தல் குற்றமாகும். 

அந்த நபருக்கு பத்து ஆண்டுகள் வரையில் சிறைக்காவலுடன் அபராதமும் சேர்த்து தண்டனையாக விதிக்கப்படும்.

Section 495- Same offence with concealment of former marriage from person with whom subsequent marriage is contracted

Whoever commits the offence defined in the last preceding section having concealed from the person with whom the subsequent marriage is contracted, the fact of the former marriage, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

Punishment-Imprisonment for 10 years and fine-Cognizable-Non-bailable-Triable by Magistrate of the first class-Non-compoundable.

யாராவது, தான் செய்யும் ஒரு காரியம், ஒரு திருமணத்தை சட்டப்படி செல்லுபடியாக்காது என்று தெரிந்தும் , பிறரை ஏமாற்ற வேண்டும் என்ற கருத்துடன் அல்லது நேர்மையின்றி, திருமண நிகழ்ச்சிக்கான ஒரு காரியத்தை செய்வது குற்றமாகும். -அதாவது ஒரு தவறான திருமணத்தை நடத்துவது.

  அந்த நபருக்கு ஏழு ஆண்டுகள் வரையில் சிறைக்காவலுடன் அபராதமும் சேர்த்து தண்டனையாக விதிக்கப்படும்.

 

Section 496- Marriage ceremony fraudulently gone through without lawful marriage

Whoever, dishonestly or with a fraudulent intention, goes through the ceremony of being married, knowing that he is not thereby lawfully married, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
