தினம் ஒரு சட்டம் - அடிமையாக்க கடத்தினால் என்ன தண்டனை - 2

இ.த.ச 367

     யாராவது,  ஒரு மனிதரை கவரந்து செல்வதும் அல்லது கடத்தி செல்வதும் குற்றமாகும். அதற்கான காரணங்கள் அவரை ஒரு அபாயத்தில் மாட்டி விட வேண்டும் அல்லது அவரை ஒரு கொடுங்காயம் படுத்த வேண்டும் அல்லது அடிமையாக்கப்பட வேண்டும் அல்லது அவரை ஒரு இயற்க்கைக்கு மாறான பாலியல் தொல்லைக்கு உட்படுத்த வேண்டும் என்ற எண்ணத்துடனும் அல்லது இது வேல்லாம் சம்பவிக்கும் எனத் தெரிந்தும் அவரைக் கவர்ந்து அல்லது கடத்தி செல்வது குற்றமாகும்.

    இந்தக் குற்றத்திற்கு பத்து ஆண்டுகள் வரையில் சிறைக் காவலுடன் அபராதமும் சேர்த்து தண்டனையாக விதிக்கப்படும்.

Section 367- Kidnapping or abducting in order to subject person to grievous hurt, slavery, etc.

    Whoever kidnaps or abducts any person in order that such person may be subjected, or may be so disposed of as to be put in danger of being subject to grievous hurt, or slavery, or to unnatural lust of any person, or knowing it to be likely that such person will be so subjected or disposed of, 

    shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

 யாராவது , ஒருவர் மற்றோருவரை கவர்ந்து அல்லது கடத்திக் கொண்டு வந்திருக்கிறார் என தெரிந்தும் அல்லது நம்புவதற்கான காரணங்கள் இருந்தும். அவர் கடத்தி அல்லது கவர்ந்து வந்திருக்கு நபரை யாருக்கும் தெரியாமல் மறைத்து வைப்பதும் அல்லது சிறையில் வைப்பதும் குற்றமாகும்.

 

    இந்தக் குற்றத்திற்கு கடத்துபவருக்கு கிடைக்கும், பத்து ஆண்டுகள் வரையில் சிறைக் காவலுடன் அபராதமும் சேர்த்து தண்டனையாக விதிக்கப்படும் என்ற அதே தண்டனை அவர்களுக்கும் விதிக்கப்படும்.

Section 368- Wrongfully concealing or keeping in confinement, kidnapped or abducted person

   Whoever, knowing that any person has been kidnapped or has been abducted, wrongfully conceals or confines such person, 

    shall be punished in the same manner as if he dad kidnapped or abducted such person with the same intention or knowledge, or for the same purpose as that with or for which he conceals or detains such person in confinement.
