குற்றம் நடைப்பெறுவதைத் தடுக்கும் கடமையுள்ள பொது ஊழியர், அந்தக் கடமையை நிறைவேற்றாவிடில் அவருக்கு
அந்தக் குற்றத்துக்கு உரிய உச்ச கட்ட தண்டனையில் பாதித் தண்டனை விதிக்கப்படும்
குற்றம் நடைபெறுவதற்கான ஏற்பாடுகளைத் தடுக்ககாவிடினும், அவற்றை மறைக்க முயன்றாலும், அவற்றைப்பற்றித் திரித்துக் கூறினாலும், அந்த பொது ஊழியர் குற்ற கூடந்தையானவராகக் கருதப்படுவார். அந்தக் குற்றம் நடைப்பெற்றால் மேலே சொல்லப்பட்டப்படி பாதித்தண்டனை வழங்கப்படும். அந்தக் குற்றம், மரண தண்டனை அல்லது ஆயுள் தண்டனைக்குரியதாக இருப்பின் அவருக்கு பத்தாண்டுகளுக்கு மேற்ப்படாத சிறைவாசம் தண்டனையாக விதிக்கப்படும்.
அந்த குற்றம் நடைப்பெறாவிட்டால், குற்றத்துக்குரிய உச்ச கட்ட தண்டனையில் நான்கில் ஒரு பங்கைச் சிறைவாசமாகவும் அல்லது அபராதமாகவும் அல்லது இரண்டும் சேர்த்தும் தண்டனையாக விதிக்கப்பட வேண்டும்
Section 119 in The Indian Penal Code
119 Public servant concealing design to commit offence which it is
his duty to prevent. —Whoever, being a public servant, intending to
facilitate or knowing it to be likely that he will thereby facilitate
the commission of an offence which it is his duty as such public servant
to prevent; 71 [voluntarily conceals by any act or
omission or by the use of encryption or any other information hiding
tool, the existence of a design] to commit such offence, or makes any
representation which he knows to be false respecting such design; If
offence be committed. —shall, if the offence be committed, be punished
with imprisonment of any description provided for the offence, for a
term which may extend to one-half of the longest term of such
imprisonment, or with such fine as is provided for that offence, or with
both;
If offence be punishable with death, etc. —or, if the offence be punishable with death or 72 [imprisonment for life], with imprisonment of either description for a term which may extend to ten years; If offence be not committed. —or if the offence be not committed, shall be punished with imprisonment of any description provided for the offence for a term which may extend to one-fourth part of the longest term of such imprisonment or with such fine as is provided for the offence, or with both. Illustration A, an officer of police, being legally bound to give information of all designs to commit robbery which may come to his knowledge, and knowing that B designs to commit robbery, omits to give such information, with intent to facilitate the commission of that offence. Here A has by an illegal omission concealed the existence of B's design, and is liable to punishment according to the provision of this section.
