 தினம் ஓரு சட்டம் - இ.த.ச 119


     குற்றம் நடைப்பெறுவதைத் தடுக்கும் கடமையுள்ள பொது ஊழியர், அந்தக் கடமையை நிறைவேற்றாவிடில் அவருக்கு 
அந்தக் குற்றத்துக்கு உரிய உச்ச கட்ட தண்டனையில் பாதித் தண்டனை விதிக்கப்படும்

    குற்றம் நடைபெறுவதற்கான ஏற்பாடுகளைத் தடுக்ககாவிடினும், அவற்றை மறைக்க முயன்றாலும், அவற்றைப்பற்றித் திரித்துக் கூறினாலும், அந்த பொது ஊழியர் குற்ற கூடந்தையானவராகக் கருதப்படுவார். அந்தக் குற்றம் நடைப்பெற்றால் மேலே சொல்லப்பட்டப்படி பாதித்தண்டனை வழங்கப்படும். அந்தக் குற்றம், மரண தண்டனை அல்லது ஆயுள் தண்டனைக்குரியதாக இருப்பின் அவருக்கு பத்தாண்டுகளுக்கு மேற்ப்படாத சிறைவாசம் தண்டனையாக விதிக்கப்படும்.

    அந்த குற்றம் நடைப்பெறாவிட்டால், குற்றத்துக்குரிய உச்ச கட்ட தண்டனையில் நான்கில் ஒரு பங்கைச் சிறைவாசமாகவும் அல்லது அபராதமாகவும் அல்லது இரண்டும் சேர்த்தும் தண்டனையாக விதிக்கப்பட வேண்டும்

Section 119 in The Indian Penal Code

     119 Public servant concealing design to commit offence which it is his duty to prevent. —Whoever, being a public servant, intend­ing to facilitate or knowing it to be likely that he will thereby facilitate the commission of an offence which it is his duty as such public servant to prevent; 71 [voluntarily conceals by any act or omission or by the use of encryption or any other information hiding tool, the existence of a design] to commit such offence, or makes any represen­tation which he knows to be false respecting such design; If offence be committed. —shall, if the offence be committed, be punished with imprisonment of any description provided for the offence, for a term which may extend to one-half of the longest term of such imprisonment, or with such fine as is provided for that offence, or with both; 

 If offence be punishable with death, etc. —or, if the offence be punishable with death or 72 [imprisonment for life], with imprison­ment of either description for a term which may extend to ten years; If offence be not committed. —or if the offence be not committed, shall be punished with imprisonment of any description provided for the offence for a term which may extend to one-fourth part of the longest term of such imprisonment or with such fine as is provided for the offence, or with both. Illustration A, an officer of police, being legally bound to give information of all designs to commit robbery which may come to his knowledge, and knowing that B designs to commit robbery, omits to give such information, with intent to facilitate the commission of that offence. Here A has by an illegal omission concealed the exist­ence of B's design, and is liable to punishment according to the provision of this section.

       மரண தண்டனை அல்லது ஆயுள் தண்டனை விதிக்கத்தக்க குற்றம் நடைப்பெற இருக்கின்றது என்று அறிந்தவுடன் அதனைத் தடுக்க நடவடிக்கை எடுக்க வேண்டும், தெரிந்த பின்னும் அதனை மறைப்பதும் அல்லது திரித்துக் கூறுவதும் குற்றமாகும்

       ஆக இந்த நிலையில் அந்தக் குற்றம் நடைப்பெற்றால் அந்த நபருக்கு ஏழு ஆண்டுகள் வரை சிறைத்தண்டனை கிடைக்கும்.[ அந்தக் குற்றம் நடைப்பெறவில்லையெனில், அந்த நபருக்கு மூன்று ஆண்டுகள் வரை சிறைத்தண்டனை கிடைக்கும்]

இரண்டு நிலைகளிலும் சிறைவாசத்துடன் அபராதமும் விதிக்கப்படும்


Section 118 in The Indian Penal Code
118 Concealing design to commit offence punishable with death or imprisonment for life. —Whoever intending to facilitate or know­ing it to be likely that he will thereby facilitate the commis­sion of an offence punishable with death or 69 [imprisonment for life]; 70 [voluntarily conceals by any act or omission or by the use of encryption or any other information hiding tool, the existence of a design] to commit such offence or makes any representa­tion which he knows to be false respecting such design, If offence be committed — if offence be not committed. —shall, if that offence be committed, be punished with imprisonment of either description for a term which may extend to seven years, or, if the offence be not committed, with imprisonment of either description, for a term which may extend to three years; and in either case shall also be liable to fine. 
Illustration A, knowing that dacoity is about to be committed at B, falsely informs the Magistrate that a dacoity is about to be committed at C, a place in an opposite direction, and thereby misleads the Magis­trate with intent to facilitate the commission of the offence. The dacoity is committed at B in pursuance of the design. A is punishable under this section.

      ஒரு குற்றம் நடைப்பெறுவதற்கு உதவி செய்ய வேண்டும் அல்லது தம் செயலால் அத்தகைய உதவி கிடைக்கும் என்று தெரிந்து கொன்டு, தண்டனைப் பெறத்தக்க குற்றத்தைப் பற்றிய தகவலை மறைத்தும், கூறாமல் விடுத்தும், திரித்தும் கூறியும் செயல் புரிபவருக்கும், அத்தகைய குற்றம் நடைப்பெற்றால் அதற்கென விதிக்கப்பட்டுள்ள உச்சகட்ட தண்டனையில் நான்கில் ஒரு பங்கைத் தண்டனையாகத் தர வேண்டும்

     அந்தக் குற்றம் நடைப்பெறவிடில் அதற்குரிய தண்டனையில் எட்டில் ஒரு பங்குத் தண்டனையைச் சிறைத் தண்டனையாகவும் அல்லது அபராதமாகவும் அல்லது இரண்டும் சேர்த்தும் தண்டனையாகப் பெறுவார்

Concealing design to commit offence punishable with impris­onment.—Whoever, intending to facilitate or knowing it to be likely that he will thereby facilitate the commission of an of­fence punishable with imprisonment, voluntarily conceals, by any act or illegal omission, the exist­ence of a design to commit such offence, or makes any representa­tion which he knows to be false respecting such design, If offence be committed—if offence be not committed.—shall, if the offence be committed, be punished with imprisonment of the description provided for the offence, for a term which may extend to one-fourth, and, if the offence be not committed, to one-eighth, of the longest term of such imprisonment, or with such fine as is provided for the offence, or with both.

     117. அதே போன்று பொதுமக்கள் ஒன்றுகூடி ஒரு குற்றத்தைப் புரிவதற்கு ஒருவன் உடந்தையாக இருந்து, அதன் விளைவாக பத்துப் பேருக்கு மேல் கூடிக் குற்ற செயல் புரிந்தால், உடந்தையாக இருந்தவருக்கு மூன்று ஆண்டுகள் வரை சிறைக்காவல் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும்



Section 117 in The Indian Penal Code
117. Abetting commission of offence by the public or by more than ten persons.—Whoever abets the commission of an offence by the public generally or by any number or class of persons exceeding ten, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. 
Illustration A affixes in a public place a placard instigating a sect consist­ing of more than ten members to meet at a certain time and place, for the purpose of attacking the members of an adverse sect, while engaged in a procession. A has committed the offence de­fined in this section. 

CLASSIFICATION OF OFFENCE 
Punishment—Imprisonment for 3 years, or fine, or both—According as offence abetted is cognizable or non-cognizable—According as offence abetted is bailable or non-bailable—Triable by court by which offence abetted is triable—Non-compoundable.

      மரண தண்டனை அல்லது ஆயுள் தண்டனை விதிக்கத்தக்க குற்றங்களுக்கு ஒருவன் உடந்தையாக இருக்கிறான். அந்தக் குற்றம் நடைபெறாவிட்டாலும் அவனுக்கு ஏழு ஆண்டுகள் வரையில் சிறைக்காவலுடன் அபராதமும் விதிக்கப்படும். அந்த குற்றத்திற்கு உரிய சட்டத்தில் வேறு எதாவது தண்டனை விதிக்கப்பட வேண்டும் என்று குறிப்பிட்டிருந்தால் அத்தகைய தண்டனையே வழங்கப்பட வேண்டும்.

     ஆனால் , அப்படி உடந்தையாக இருந்த காரணத்தினால் அவன் பொறுப்பேற்க வேண்டிய செயல் நடைப்பெற்று, அதன் விளைவாக யாருக்காவது காயம் ஏற்ப்பட்டால், அவனுக்குப் பதினான்கு ஆண்டுகள் வரை சிறைக்காவலுடன் அபராதமும் விதிக்கப்பட வேண்டும்

Section 115 in The Indian Penal Code
     
       115. Abetment of offence punishable with death or imprisonment for life—if offence not committed.—Whoever abets the commission of an offence punishable with death or 1[imprisonment for life], shall, if that offence be not committed in consequence of the abetment, and no express provision is made by this Code for the punishment of such abetment, be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine; If act causing harm be done in consequence.—and if any act for which the abettor is liable in consequence of the abetment, and which causes hurt to any person, is done, the abettor shall be liable to imprisonment of either description for a term which may extend to fourteen years, and shall also be liable to fine. 


Illustration A instigates B to murder Z. The offence is not committed. If B had murdered Z, he would have been subject to the punishment of death or 1[imprisonment for life]. Therefore A is liable to imprisonment for a term which may extend to seven years and also to a fine; and if any hurt be done to Z in consequence of the abetment, he will be liable to imprisonment for a term which may extend to fourteen years, and to fine. 

CLASSIFICATION OF OFFENCE 
Para I: Punishment—Imprisonment for 7 years and fine—According as offence abetted is cognizable or non-cognizable—non-bailable—Triable by court by which offence abetted is triable—Non-com­poundable. 

Para II: Punishment—Imprisonment for 14 years and fine—According as offence abetted is cognizable or non-cognizable—non-bailable—Triable by court by which offence abetted is triable—Non-com­poundable.

சிறைக்காவலைத் தண்டணையாகப் பெறத்தக்க குற்றங்களுக்கு ஒருவன் உடந்தையாக இருக்கிறான். அந்தக்குற்றம் செய்யப்படவில்லை. இருப்பினும் உடந்தையாக இருப்பவனுக்கு அந்தக் குற்றத்துக்குரிய உச்சப்பட்சத் தண்டனையில் நான்கில் ஒரு பங்கு சிறைக்காவல் அல்லது அபராதம் அல்லது அபராத த்துடன் கூடிய  சிறைக்காவல் தண்டணையாகப் விதிக்கப்படும்

   ஆனால் அந்த குற்ற உடந்தையாக்கென தனியாகத் தண்டனை தருவதற்கான விளக்கம் சட்டத்தில் தரப்பட்டிருந்தால் அவருக்கு அத்தகைய தண்டனையே வழங்கப்பட வேண்டும்.

     குற்றத்திற்கு உடந்தையாக இருப்பவர் அல்லது அவரால் உதவி செய்யப்படுபவர் குற்றத்தை தடுக்க கடமைப்பட்டுள்ள பொது ஊழியராக இருப்பின், அவருக்கு அந்தக் குற்றத்திற்கென விதிக்கப்பட்டுள்ள உச்சபட்சத் தண்டனையில் பாதியைக் சிறைக்காவலாகவும் அல்லது குற்றத்திற்கு விதிக்கப்பட்டுள்ள அபராதாமாகவும் அல்லது இரண்டும் சேர்த்தும் தண்டனையாக விதிக்கப்படலாம்



Section 116 in The Indian Penal Code
116. Illustrations
(a) A offers a bribe to B, a public servant, as a reward for showing A some favour in the exercise of B’s official functions. B refuses to accept the bribe. A is punishable under this sec­tion. 
(b) A instigates B to give false evidence. Here, if B does not give false evidence, A has nevertheless committed the offence defined in this section, and is punishable accordingly. 
(c) A, a police-officer, whose duty it is to prevent robbery, abets the commission of robbery. Here, though the robbery be not committed, A is liable to one-half of the longest term of impris­onment provided for that offence, and also to fine. 
(d) B abets the commission of a robbery by A, a police-officer, whose duty it is to prevent that offence. Here, though the rob­bery be not committed, B is liable to one-half of the longest term of imprisonment provided for the offence of robbery, and also to fine. CLASSIFICATION OF OFFENCE 
Para I:—Punishment—Imprisonment extending to a quarter part of the longest term, provided for the offence, or fine, or both—Accord­ing to offence abetted is cognizable or non-cognizable—According as offence abetted is bailable or non-bailable—Triable by court by which offence abetted is triable—Non-compoundable. 
Para II: Punishment—Imprisonment extending to half of the longest term, provided for the offence, or fine, or both—According as offence abetted is cognizable or non-cognizable—According as offence abetted is bailable or non-bailable—Triable by court by which offence abetted is triable—Non-compoundable.

      குற்றத்திற்கு உடந்தையாக இருப்பவன் குற்றம் நடைப்பெறும் நேரத்தில் குற்றம் புரிபவரோடு இருந்தால், அவனையும் அந்தக் குற்றத்தில் பங்கேற்றதாகவே கருதி தண்டிக்க வேண்டும், அந்த இடத்தில் அவன் இல்லையென்றால் உடந்தையாக இருந்த குற்றம் மட்டுமே அவனைச் சாரும்.


Section 114 in The Indian Penal Code
      Abettor present when offence is committed.—Whenever any person, who is absent would be liable to be punished as an abettor, is present when the act or offence for which he would be punishable in consequence of the abetment is committed, he shall be deemed to have committed such act or offence.
