தினம் ஒரு சட்டம் - இந்திய தேசத்தை நிந்தித்தால்

இ.த.ச 124அ

            யாராவது, சட்டப்படி அமைக்கப்பட்டுள்ள அரசாங்கத்தை, மக்களுக்கு எதிராக செயல் படுகின்ற அரசாங்கம் என்கிற வெறுப்பையும் அல்லது விரோத உணர்ச்சியையும் தூண்டி விடுவதற்காக ஒருவர் தம்முடைய எழுத்தால் அல்லது பேச்சால் அல்லது சைகையால் அல்லது படத்தால் அல்லது வேறு எந்த விதத்திலாவது இத்தகைய காரியத்தை செய்வது குற்றமாகும்.

இந்தக் குற்றத்திற்கு ஆயுள் தண்டனையுடன் கூடிய அபராதமும் அல்லது மூன்று ஆண்டுகளுடன் கூடிய அபராதமும் சேர்த்து அல்லது அபராதம் மட்டும் தண்டனையாக விதிக்கப்படும்.

விளக்கம் 1 - அவநம்பிக்கையை உருவாக்குவது என்பது 

தேச விரோதத்தை குறிக்கும்

விளக்கம் 2 - இந்திய நாட்டின் சட்டத்திற்கு உட்பட்டு 

அரசின் செயலை கூறித்து உண்மையான

ஒரு சம்பவத்தைக் குறித்து கூறுவது குற்றமாகாது.

விளக்கம்  3 - இந்திய ஜனநாயகத்தின்படி அரசின் நிர்வாக 

குறைகளைப் பற்றி ஒரு கன்டனம் 

  தெரிவிப்பது குற்றமாகாது, இத்தகைய கண்டனம் ஒரு 

அரசின் தேச விரோத உணர்ச்சியை தூண்டும் 

உணர்ச்சிக்களைத் தூண்டும் நிலைக்குப் போகாமல் 

காப்பதே இந்தப் பிரிவின் நோக்கமாகும். 

Section 124-A- Sedition

   Whoever, by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards. 2[* * *] the Government established by law in 3[India], 4[* * *] 

    shall be punished with 5[imprisonment for life], to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.

Explanation 1-The expression "disaffection" includes disloyalty and all feelings of enmity.

Explanation 2-Comments expressing disapprobation of the measures of the attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.

Explanation 3-Comments expressing disapprobation of the administrative or other action of the Government without exciting or attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.

2. The words "Her Majesty or" omitted by the A.O. 1950. The words "or the Crown Representative inserted after the word "Majesty" by the A.O. 1937 were omitted by the A.O. 1948.

3. The words "British India" have successively been subs. by the A.O. 1948, the A.O.1950 and Act 3 of 1951, sec.3 and sch. to read as above.

4. The words "or "British Burma" ins. by the A.O.1937 omitted by the A.O.1948.

5. Subs. by Act 26 of 1955, sec.117 and sch., for "Transportation for life or any shorter term" (w.e.f.1-1-1956).
