தினம் ஓரு சட்டம் - இ.த.ச 114

      குற்றத்திற்கு உடந்தையாக இருப்பவன் குற்றம் நடைப்பெறும் நேரத்தில் குற்றம் புரிபவரோடு இருந்தால், அவனையும் அந்தக் குற்றத்தில் பங்கேற்றதாகவே கருதி தண்டிக்க வேண்டும், அந்த இடத்தில் அவன் இல்லையென்றால் உடந்தையாக இருந்த குற்றம் மட்டுமே அவனைச் சாரும்.


Section 114 in The Indian Penal Code
      Abettor present when offence is committed.—Whenever any person, who is absent would be liable to be punished as an abettor, is present when the act or offence for which he would be punishable in consequence of the abetment is committed, he shall be deemed to have committed such act or offence.

தினம் ஓரு சட்டம் - இ.த.ச 113

       ஒரு குறிப்பிட்ட விளைவினை உண்டாக்க வேண்டும் என்ற கருத்துடன் ஒருவர் ஒரு செயலுக்கு உடந்தையாக இருக்கிறார். அந்தச் செயலின் விளைவுக்கு அவருக்கு பொருப்பு உண்டு. ஆனால் அந்த செயல் ஒரு மாறுபட்ட விளைவினைத் தருகின்றது. குற்றத்துக்கு உடந்தையாக இருப்பவருக்கு தாம் எண்ணியப்படி நடக்கவில்லை என்றாலும், புதிய விளைவுக்கும் அவர் பொருப்பேற்க வேண்டும்.

உதாரணம்:
 
     ஒருவருக்கு கொடுங்காயம் உண்டாக்க வேண்டும் என்ற கருத்துடன் மற்றோருவரைத் துண்டுகிறோம். அதன் விளைவாக நபர் மரணமடைகிறார். ஏற்படக்கூடிய கொடுங்காயத்தினால் அத்தகைய மரணம் சம்பவிக்கக்கூடும் என்பதைத் தூண்டியவர் உணர்ந்திருந்தால், அவருக்குக் கொலைக்குற்றத்திற்கு உரிய தண்டனை கிடைக்கும்

Liability of abettor for an effect caused by the act abetted different from that intended by the abettor.—When an act is abetted with the intention on the part of the abettor of causing a particular effect, and an act for which the abettor is liable in consequence of the abetment, caused a different effect from that intended by the abettor, the abettor is liable for the effect caused, in the same manner and to the same extent as if he had abetted the act with the intention of causing that effect, provided he knew that the act abetted was likely to cause that effect. 
 
Illustration 
 
A instigates B to cause grievous hurt to Z. B, in consequence of the instigation, causes grievous hurt to Z. Z dies in conse­quence. Here, if A knew that the grievous hurt abetted was likely to cause death, A is liable to be punished with the punishment provided for murder. CLASSIFICATION OF OFFENCE Punishment—Same as for offence committed—According as offence abetted is cognizable or non-cognizable—According as offence abetted is bailable or non-bailable—Triable by court by which offence abetted is triable—Non-compoundable.

இதுப்போல நிறைய கண்டுப்பிடிப்புகளை அவர் செய்தார் சிறு பிரளயம் முதற்கொன்டு அவர் லண்டனில் தினமும் தவறாமல் காலையில் அந்த தட்பவெப்ப நிலையில் குளித்து புஜை செய்தது அவருக்கு தீராத TB  நோயைத்தந்தது அதனால் தன் தாயார் மற்றும் மனையாட்டியை காணவந்தார் தாயகம் வந்தார். மிக குறைந்த வயதில் உயிர் நீத்தார். அவர் இன்றைய கணிணி உலகில் இருந்திருந்தால் நிறைய சாதனைகளை புரிந்திருப்பார்

படித்ததில் பிடித்தது - சூது கவ்வும்


தருமத்தின் வாழ்வதனைச் சூது கவ்வும்


“தருமத்தின் வாழ்வதனைச் சூது கவ்வும்;
தருமம் மறுபடி வெல்லும்” எனு மியற்கை
மருமத்தை நம்மாலே உலகங் கற்கும்
வழிதேடி விதி இந்தச் செய்கை செய்தான்.
கருமத்தை மேன்மேலுங காண்போம்;இன்று
கட்டுண்டோம்,பொறுத்திருப்போம்; காலம் மாறும்
தருமத்தை அப்போது வெல்லக் காண்போம்.
தனுஉண்டு காண்டீவம் அதன் பேர்’என்றான்.





விளக்கம்:

“தருமத்தின் வாழ்வைச் சூது விழுங்கும் ஆனால், தருமம் மறுபடியும் எப்படியாவது வெற்றி பெற்றே தீரும். இது இயற்கை உண்மை. அதுவரை நாம் பொறுமையாக இருப்பதே நல்லது. கோபம் வேண்டாம். யார் மேலும் குற்றமில்லை; இன்று
கட்டுண்டோம்,பொறுத்திருப்போம்; காலம் மாறும்
தருமத்தை அப்போது வெல்லக் காண்போம்”, என்று சொல்லி, வீமனின் கோபத்தைத் தணித்தான் அருச்சுனன். மேலும் தன் கையில் வீல் உள்ளது என்றான்


என் விளக்கம்:

இன்று நானும் இதுப்போல சூழ்நிலையில் இருக்கின்றேன் தருமம் மறுபடியும் எப்படியாவது வெற்றி பெற்றே தீரும் என்ற நம்பிக்கையுடன் பார்ப்போம் தர்மமா அல்லது அதர்மமா.
மேலும் என் கையில் நீதி உள்ளது என்கிறேன்.

      இ.த.ச 111 குறிப்பிட்டுள்ள உதாரணத்தின்படி , ஒரு குற்றத்திற்கு உடந்தையாக இருந்து அந்தக் குற்றத்துடன் வேறொரு குற்றமும் புரியப்பட்டால் , அந்த குற்றத்துக்கு உடந்தையாக இருந்தவருக்கு ஒவ்வொரு குற்றத்துக்கும் தனித்தனியாக தண்டனை வழங்கப்பட வேண்டும்.

Abettor when liable to cumulative punishment for act abetted and for act done.—If the act for which the abettor is liable under the last preceding section is committed in addition to the act abetted, and constitutes a distinct offence, the abettor is liable to punishment for each of the offences. 


Illustration A instigates B to resist by force a distress made by a public servant. B, in consequence, resists that distress. In offering the resistance, B voluntarily causes grievous hurt to the officer executing the distress. படித்ததில் பிடித்தது : Lord Ullins Daughter







Lord Ullin's Daughter - பிரபு உள்ளின் மகள்

சீப்டன்: படகோட்டியே பயப்படாதே என்னை அந்த கரையில் விட முடியுமா நான் எவ்வளவு வெள்ளி பணம் வேண்டுமானாலும் தருகிறேன்

'Now who be ye would cross Lochgyle,
This dark and stormy water?'
'Oh! I'm the chief of Ulva's isle,
And this Lord Ullin's daughter.




படகோட்டி: யாருயா நீ இந்த நேரத்துலஇந்த நதியை கடக்க சொல்லுற என்ன விஷயம் சொல்லு


சீப்டன்: நான் உல்வா தீவின் தலைவன் இவள் என் காதலி உள்ளின் மகள்
 
'And fast before her father's men
Three days we've fled together,
For should he find us in the glen,
My blood would stain the heather.



சீப்டன்: வேகமாக ஆற்றைக்கடக்க உதவி செய் இவளின் தந்தையின் ஆட்கள் எங்களை தேடுகிறார்கள் கடந்த மூன்று நாளாக நாங்கள் ஓடிக்கொன்டிருக்கின்றோம் எங்களைப்பரா்த்தால் அவர்கள் கொன்றுவிடுவார்கள்


 'His horsemen hard behind us ride;
Should they our steps discover,
Then who will cheer my bonny bride
When they have slain her lover?'


சீப்டன்: குதிரை வீரர்கள் எங்கள் பின்னால் வருகிறார்கள் என்னை அவர்கள் கொன்றுப்போட்டால் என் காதலியின் சந்தோஷ நாட்களை என்ன முடியுமோ

 Outspoke the hardy Highland wight:
'I'll go, my chief - I'm ready:
It is not for your silver bright,
But for your winsome lady.


படகோட்டி: சீப் நான் தயார் வெள்ளிக்காக இல்ல உன்னுடைய காதலிக்காக

 'And by my word, the bonny bird
In danger shall not tarry:
So, though the waves are raging white,
I'll row you o'er the ferry.'


படகோட்டி: நமக்கேதிரே பெரிய வெள்ளம் போல நீர் உள்ளது இருந்தாலும் உங்களுக்காக படகை செலுத்துகிறேன்

 By this the storm grew loud apace,
The water-wraith was shrieking;
And in the scowl of heaven each face
Grew dark as they were speaking.


கவிஞர்: காண்போரை கவலை பட செய்யும் நதியின் அலைகள் ஒரு நரகத்தைப்போல காட்சியளித்தது
 

But still, as wilder blew the wind,
And as the night grew drearer,
Adown the glen rode armed men-
Their trampling sounded nearer.



கவிஞர்  : நல்ல சுறாவெளி விசியது இருளும் மெல்ல சுழ்ந்தது குதிரைவீரர்கள் வரும் சத்தமும் கேட்டது


'Oh! Haste thee, haste!' the lady cries,
'Though tempests round us gather;
I'll meet the raging of the skies,
But not an angry father.'



சீப்டன்காதலி :வேகமாக! வேகமாக!! அவர்கள் வந்துவிட்டார்கள் நான் இந்த அலையைக்கூட எதிர்கொள்ள முடியும் ஆனால் என்னால் என் தந்தையை என்னால் எதிர் கொள்ள முடியாது

The boat has left a stormy land,
A stormy sea before her-
When oh! Too strong for human hand,
The tempest gathered o'er her.


கவிஞர்: படகு கரையை விட்டு நதியில் இறங்கியது இருவரின் இதயத்திலும்

இடி இறங்கியது போல இருந்தது

And still they rowed amidst the roar
Of waters fast prevailing;
Lord Ullin reach'd that fatal shore-
His wrath was chang'd to wailing.



கவிஞர்: படகு நதியின் நடுவில் சென்றுக்கொன்டிருந்தது அப்போது பிரபு உள்ளீன் தன் ஆட்களுடன் அங்கு வந்தார் தன் மனதை மாற்றிக்கொன்டார் அவர்களை சேர்த்து வைக்க வேன்டும் அவருள் எழ்ந்தது


 For sore dismay'd, through storm and shade,
His child he did discover;
One lovely hand she stretch'd for aid,
And one was round her lover.


கவிஞர்: அப்போது எழந்த ஒரு பெரிய அலை அவர்களை சூழ்ந்துக்கொன்டது



'Come back! Come back!' he cried in grief,
'Across this stormy water;
And I'll forgive your Highland chief,
My daughter!- oh, my daughter!'

பிரபு உள்ளின் : மகளே வந்துவிடு ! வந்துவிடு !! அந்த ஆழிப்பேரலையிலிருந்து நான் உன்னையும் உன் காதலனையும் மன்னித்து விடுகிறேன் என் மகளே! என் மகளே!!

 

'Twas vain: the loud waves lash'd the shore,
Return or aid preventing;
The waters wild went o'er his child,
And he was left lamenting.



கவிஞர்: அப்போது எழந்த பெரிய அலை அவர்களை சூழ்ந்துக்கொன்டது எந்த உதவியும் கிடைக்கவில்லை நதி அவர்களை இழ்த்துக்கொன்டது. உள்ளீன் அழதுக்கொன்டு வீடு திரும்பினான்.
