தினம் ஓரு சட்டம் - இ.த.ச 216A - கொள்ளை, கூட்டுக் கொள்ளை ஆகியவர்களுக்கு புகலிடம் அளித்தல்



கொள்ளை, கூட்டுக் கொள்ளை ஆகிய குற்றங்களைச் செய்ந்தவர்களுக்குப் புகலிடம் கொடுப்பவர்களுக்கும் அல்லது அத்தகைய குற்றம் புரிய ஆயத்தமாக உள்ளவர்கள் என்று தெரிந்தும் அவர்களுக்குப் புகலிடம் கொடுப்பதும் அவர்களைத் தண்டனையிலிருந்து மறைப்பதற்கும், குற்றம் செய்ய அனுசரனையாக இருப்பதற்காகவும் புகலிடம் கொடுப்பதும் குற்றமாகும்.





   இந்தக் குற்றத்திற்கு ஏழு ஆண்டுகள் வரை கடுங்காவலுடன் அபராதமும் தண்டனையாக விதிக்கப்படும்.



இந்தியாவுக்கு வெளியே இத்தகைய குற்றத்தைப் புரிந்தாலும் இந்த சட்டத்தின் கீழ் வரும்.

விதிவிளக்கு - கணவன் மனைவிக்கும் அல்லது மனைவி தன் கணவனுக்கும் அளிக்கும் புகலிடம் இப்பிரிவின் கீழ் வராது.



Section 216A in The Indian Penal Code
214 [216A. Penalty for harbouring robbers or dacoits.
—Whoever, knowing or having reason to believe that any persons are about to commit or have recently committed robbery or dacoity, harbours them or any of them, with the intention of facilitating the commission of such robbery or dacoity or of screening them or any of them from punishment, 
shall be punished with rigorous impris­onment for a term which may extend to seven years, and shall also be liable to fine. 
 
 Explanation.—For the purposes of this section it is immaterial whether the robbery or dacoity is intended to be committed, or has been committed, within or without 2[India]. 
 (Exception) —This provision does not extend to the case in which the harbour is by the husband or wife of the offender.]

தினம் ஓரு சட்டம் - இ.த.ச 216 - தப்பிய குற்றவாளிக்கு புகலிடம் அளித்தல்





  1. சட்டப்படி காவலில் வைக்கப்பட்ட குற்றவாளி தப்பிவிடுகிறார்
  
   --அல்லது--

  2. ஒரு குற்றவாளியை சிறைப்பிடிக்க வேண்டும் என்று அதிகாரம் பெற்ற பொது ஊழியர் உத்தரவிடுகிறார் அவர் தன்னை காவலில் வைக்கப்படுவதிலிருந்து தப்பி விடுகிறார்

     இந்த இரண்டு நிலைகளிலும் தப்பித்த குற்றவாளிக்கு புகலிடம் கொடுப்பதும் அல்லது குற்றவாளியை சிறைப்பிடிக்காமல் காப்பதும் குற்றமாகும்
  


  அத்தகைய புகலிடம் மரணத்தண்டனைக் குற்றவாளிக்கு வழங்கினால் ஏழு ஆண்டுகள் வரை சிறைக்காலுடன் கூடிய அபராதம் புகலிடம் தந்தவருக்கு வழங்கப்படும்.


      அத்தகைய புகலிடம் ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரைத் சிறைக்காவலுடன் கூடிய தண்டனையாக இருந்தால் புகலிடம் தந்தவருக்கு மூன்று  ஆண்டுகள் வரை சிறைக்காவலுடன் அபராதமும் அல்லது மூன்று  ஆண்டுகள் வரை சிறைக்காவல் தண்டனையாக வழங்கப்படும்.

 




    அத்தகைய புகலிடம் ஒர் ஆண்டுகள் உட்பட்ட குற்றத்தைப் புரிந்திருந்தால் புகலிடம் தந்தவருக்கு குற்றவாளிப்பெறும் தண்டனையில் நான்கில் ஒருப்பங்கைச் சிறைக்காவலாகவும் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும்.



விதிவிளக்கு - கணவன் மனைவிக்கும் அல்லது மனைவி தன் கணவனுக்கும் அளிக்கும் புகலிடம் இப்பிரிவின் கீழ் வராது.


216. Harbouring offender who has escaped from custody or whose apprehension has been ordered.
—Whenever any person convicted of or charged with an offence, being in lawful custody for that offence, escapes from such custody; or whenever a public servant, in the exercise of the lawful powers of such public servant, orders a certain person to be apprehended for an offence, whoever, knowing of such escape or order for apprehension, harbours of conceals that person with the intention of preventing him from being apprehended, shall be punished in the manner following that is to say,
— if a capital offence.—if the offence for which the person was in custody or is ordered to be apprehended is punishable with death, he shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine; if punishable with imprisonment for life, or with imprisonment.
—if the offence is punishable with 1[imprisonment for life], or imprisonment for ten years, he shall be punished with imprison­ment of either description for a term which may extend to three years, with or without fine; and if the offence is punishable with imprisonment which may extend to one year and not to ten years, he shall be punished with imprisonment of the description provided for the offence for a term which may extend to one-fourth part of the longest term of the imprisonment provided for such offence, or with fine, or with both. 2[“Offence” in this section includes also any act or omission of which a person is alleged to have been guilty out of 3[India], which, if he had been guilty of it in 3[India], would have been punishable as an offence, and for which he is, under any law relating to extradition, 4[***] or otherwise, liable to be appre­hended or detained in custody in 3[India]; and every such act or omission shall, for the purposes of this section, be deemed to be punishable as if the accused person had been guilty of it in 3[India].]
(Exception) —This provision does not extend to the case in which the harbour or concealment is by the husband or wife of the person to be apprehended.

தினம் ஓரு சட்டம் - இ.த.ச 212 - குற்றவாளிக்கு புகலிடம் அளித்தல்




           குற்றவாளிகளுக்கும் மற்றும்  குற்றம் புரிந்தவர்கள் என்று தெரிந்தப்பின் அவர்கள் சட்டத்தின் பிடியிலிருந்து தப்பி வந்து அடைக்கலம் கேட்கும்போது  அவர்களை அந்த சட்டத்தின் பிடியிலிருந்து தப்பிக்க வேண்டி பாதுக்காப்பாக இருக்க அத்தகைய புகலிடம் தருவது குற்றமாகும் அந்த செயல் தண்டனைக்கு உரிய குற்றமாகும்.

    அத்தகைய புகலிடம் மரணத்தண்டனைக் குற்றவாளிக்கு வழங்கினால் ஏழு ஆண்டுகள் வரை சிறைக்காலுடன் கூடிய அபராதம் புகலிடம் தந்தவருக்கு வழங்கப்படும்.


      அத்தகைய புகலிடம் ஆயுள் தண்டனை அல்லது பத்து ஆண்டுகள் வரைத் சிறைக்காவலுடன் கூடிய தண்டனையாக இருந்தால் புகலிடம் தந்தவருக்கு மூன்று  ஆண்டுகள் வரை சிறைக்காவலுடன் அபராதமும் தண்டனையாக வழங்கப்படும்.

    அத்தகைய புகலிடம் ஒர் ஆண்டுகள் உட்பட்ட குற்றத்தைப் புரிந்திருந்தால் புகலிடம் தந்தவருக்கு குற்றவாளிப்பெறும் தண்டனையில் நான்கில் ஒருப்பங்கைச் சிறைக்காவலாகவும் அல்லது அபராதம் அல்லது இரண்டும் தண்டனையாக விதிக்கப்படும்.

212. Harbouring offender.


—Whenever an offence has been committed, whoever harbours or conceals a person whom he knows or has reason to believe to be the offender, with the intention of screening him from legal punishment; if a capital offence.

—shall, if the offence is punishable with death, be punished with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine; if punishable with imprisonment for life, or with imprisonment.—and if the offence is punishable with 1[imprisonment for life], or with imprisonment which may extend to ten years, shall be punished with imprisonment of either description for a term which may extend to three years, 


and shall also be liable to fine; and if the offence is punishable with imprisonment which may extend to one year, and not to ten years, shall be punished with imprisonment of the description provided for the offence for a term which may extend to one-fourth part of the longest term of imprisonment provided for the offence, or with fine, or with both. 

2[“Offence” in this section includes any act committed at any place out of 3[India], which, if committed in 3[India], would be punishable under any of the following sections, namely, 302, 304, 382, 392, 393, 394, 395, 396, 397, 398, 399, 402, 435, 436, 449, 450, 457, 458, 459 and 460; and every such act shall, for the purposes of this section, be deemed to be punishable as if the accused person had been guilty of it in 3[India].] 


(Exception) —This provision shall not extend to any case in which the harbour or concealment is by the husband or wife of the offender. Illustration A, knowing that B has committed dacoity, knowingly conceals B in order to screen him from legal punishment. Here, as B is liable to 1[imprisonment for life], A is liable to imprisonment of either description for a term not exceeding three years, and is also liable to fine.
