தினம் ஒரு சட்டம் - பொய் ஆவணங்களுக்கு தேவையான பொருட்களை வைத்திருந்தால் - 1

   யாராவது பொய்யாக உருவாக்கப்பட்ட ஒரு ஆவணத்திற்கு அல்லது கணினி சம்பந்தப்பட்ட ஆவணத்திற்கு தேவையான அச்சுகளையோ அல்லது வார்ப்புகளையோ அல்லது குறியீடுகளையோ போலியாக பதிப்பதும் அந்த ஆவணம் இ.த.ச பிரிவு 467 ஆவது பிரிவில் விளக்கப்பட்டுள்ள ஒர் ஆவணத்தை பொய்யாக உருவாக்கி அதனை உண்மையான ஆவணமாக பயன்படுத்த வேண்டும் என்று உருவாக்குவது குற்றமாகும்,  

   அதற்கு தேவையான சாதனங்களையும், பொருட்களையும், குறியீடுகளை தம்வசம் வைத்திருப்பதும் அத்தகைய கருத்துடனும் எண்ணத்துடனும் வைத்திருப்பது குற்றமாகும்.

  இந்தக் குற்றத்திற்கு ஆயுள் தண்டனை அல்லது ஏழு ஆண்டுகள் வரையில் சிறைக்காவல தண்டனை அத்துடன் அபராதமும் சேர்த்து தண்டனையாக விதிக்கப்படும்.

Section 475- Counterfeiting device or mark used for authenticating documents described in Section 467, or possessing counterfeit marked material

   

     Whoever counterfeits upon, or in the substance or, any material, any device or mark used for the purpose of authenticating any document described in Section 467 of this Code, intending that such device or mark shall be used for the purpose of giving the appearance of authenticity to any document then forged or thereafter to be forged on such material, or who, with such intent, has in his possession any material upon or in the substance of which any such device or mark has been counterfeited, 

    shall be punished with *[imprisonment for life], or with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

குறிப்பு - இந்த பகுதியில் உள்ளவற்றை பொது அறிவாக மட்டும் எடுத்துக் கொள்ள வேண்டும் ஏதாவது சட்ட நுனுக்கம் தவறாக இருப்பின் சுட்டிக் காட்டுங்கள் திருத்திக்கொள்கிறோம்.  இதையே இறுதி வடிவமாக எடுத்துக் கொள்ளக்கூடாது. மேலும் இது வழக்குக்குரியதல்ல.

         யாராவது , போலியாக ஒரு முத்திரை, தகடு அல்லது அது சம்பந்தப்பட்ட எந்த கருவியை உருவாக்கினாலும், அது அவருக்கு நன்றாக தெரியும் ஒரு ஏமாற்றுவதற்கும் அல்லது வஞ்சிப்பதற்கும் பயன்படுத்தடுகிறது அல்லது பயன்படுத்தக்கூடும் என்ற கருத்துடனும் அல்லது எண்ணத்துடனும் தயாரிக்கப்படுகின்றது அல்லது அச்சிடப்படுகின்றது இது குற்றமாகும். 

       
         இந்தக் குற்றம் இ.த.ச பிரிவு 467 ன் கீழ் தண்டிக்கப்படும். அவ்வாறு இந்தக் குற்றம் இ.த.ச பிரிவு 467 ன் கீழ் கூறப்பட்டதைப் போல் இல்லாமல் வேறு பிரிவின் கீழ் தண்டிக்கப்பட கூடிய காரணங்களுக்காக அதை உருவாக்குவதும் அல்லது போலியாக உருவாக்கப்பட்ட பொருள் என தெரிந்தும் தம் வசம் வைத்திருப்பதும் குற்றமாகும்.
 
          இதற்கு  ஏழு ஆண்டுகள் வரையில் சிறைக்காவலுடன் அபராதமும் சேர்த்து தண்டனையாக வழங்கப்படும்.

Section 473- Making or possessing counterfeit seal, etc., with intent to commit forgery punishable otherwise

      Whoever makes or counterfeit any seal, plate or other instrument for making an impression, intending that the same shall be used for the purpose of committing any forgery which would be punishable under any section of this Chapter other than Section 467, or, with such intent, has in his possession any such seal, plate or other instrument, knowing the same to be counterfeit, 

      shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
